For the purposes of this article, the following definitions shall apply unless the context clearly indicates or requires a different meaning:
Garage sale.
The offering for sale of personal property belonging to the person or persons residing on the premises where the sale is being conducted. Such personal property must not have been purchased for resale. Includes similar activities by any other name, such as yard sale, estate sale, etc.

Any person violating any of the provisions of this article shall be deemed guilty of a class C misdemeanor and fined in accordance with provisions of state law for class C misdemeanors.

The city police department shall have responsibility for enforcement of the provisions of this article and shall issue citations to violators as deemed necessary.

A permit to conduct a garage sale and erect signs must be obtained from city hall. The cost of such permit shall be in the amount established by city council. The permit must be displayed on the property where the sale occurs in a manner allowing it to be visible from the street.

Garage sales may only be conducted between the hours of sunrise and sunset and may not be conducted for more than three consecutive days. No more than three sales per year at the same location shall be permitted.

(a) 
Garage sale signs must be posted on private property only. Each sign shall be no larger than 288 square inches each face. Signs shall not be posted on utility poles or the street right-of-way.

Garage sale signs must not be posted more than three days before the first day of the sale and must be removed within 24 hours after the last day of the sale.
(c) 
Garage sale signs shall not cause undue traffic congestion or create a disturbance nuisance or breach of the peace.

It shall be the duty of the persons conducting the garage sale to remove all accessories to the sale after its completion and restore the premises to the state and condition that existed prior to the sale.
