For purposes of this article, the
following definitions shall apply:
Electioneering.
The posting, use, or distribution of political signs or literature,
including the use of tents, chairs, booths, tables, vehicles, or other
furniture or devices to post, use, or distribute political signs or
literature.
Human sign.
A portable sign held by or attached to a human being, including
a person dressed in costume, for the purposes of drawing attention
to text or visual images to express or make known a thought, command,
or wish.
Polling place.
City-owned or city-controlled property that is being used
as an election polling place.
Self-supporting sign.
A free-standing sign not attached to any building, wall,
fence, tree, shrub, or other improvement of any kind or not attached
to any pole, post, brace, or other frame which is inserted in the
ground. A self-supporting sign may be attached to a brace or frame
which rests on top of the ground.
Sign.
A physical object displaying text or a visual image by which
a thought is expressed, a command is made, or a wish is made known.
Voting period.
The period beginning 24 hours before a polling place opens
for early voting and ending 24 hours after the polling place closes
on election day.

(a)
It is unlawful for a person to place, attach, or otherwise affix or employ a sign on city-owned or city-controlled property, except as may be provided for in subsections
(b) and
(c).
(b)
Certain signs as designated below
may be placed within certain designated areas on the city hall complex,
as described below and as shown in illustration 1, subject to the
following time, place, manner regulations:
(1)
Any sign must either be self-supporting,
a human sign or a metal wire H-frame sign, and be located where such
signs are permitted, as follows:
(A) A self-supporting sign
is permitted only in the areas shaded in light green, light green
with green diagonal lines, and light-green with red hash lines as
shown in illustration 1.
(B) A human sign is permitted
in the areas shaded green, light green, and light-green with red hash
lines as shown in illustration 1.
(C) A metal wire H-frame
sign is permitted only in the area shaded light green with green diagonal
lines as shown in illustration 1.
(2)
A sign shall not exceed eight (8)
square feet in area.
(3)
A sign shall not exceed two (2) ft.
by four (4) ft. in dimension.
(4)
A sign, including any supporting
elements, as placed shall not exceed six (6) feet in height.
(5)
A sign shall not be illuminated.
(6)
A sign shall not contain moving parts.
(7)
Self-supporting signs and metal wire
H-frame signs shall not be placed on city hall complex at any time
other on days when city hall is being used as a polling place.
(c)
The regulations set forth in subsection
(a) and
(b) above do not apply to any city authorized signs or materials.
(d)
The city manager or a designee thereof,
may, without notice, remove and dispose of sign(s) found in violation
of this section.

(a)
It is unlawful for a person to use any area on the city hall complex grounds for the expression of First Amendment activities except as may be provided for in subsections
(b) and
(c).
(b)
All the areas shaded in green in
illustration 1 are designated as public forums for the expression
of First Amendment activities subject to the following time, place,
and manner regulations:
(1)
It is unlawful to use the areas of
the city hall parking lot designated for vehicular traffic for the
expression of First Amendment activities in a manner that impedes
vehicular or pedestrian access to and from city facilities or endangers
life or property.
(2)
It is unlawful to allow any item
brought onto the city hall complex for the purpose of conducting the
expression of First Amendment activities, including, but not limited
to, signs, literature, vehicles, tents, or furniture, to remain on
the city hall complex:
(A) During any voting period
between the hours of 7:00 p.m. or one hour after voting ends, whichever
is later, and 7 a.m. the following day; or
(B) During any other period, other than that provided by subsection
(b)(2)(A) above, between the hours of 6:00 p.m. or one hour after city hall closes to the public, whichever is later and 7:00 a.m. the following day.
(C) Any sign displayed in an area other than within the parking lot as shaded in green with red diagonal lines as provided in illustration 1 in compliance with section
14.09.002 is exempt from the requirement it be removed provided in subsection
(b)(2).
(c)
The regulations set forth in this
section do not apply to any city event or city-sponsored event on
the grounds of the city hall complex.
