The City Council shall appoint a City Planning and Zoning Commission
in accordance with applicable law. The City Council shall have all
of the rights, privileges, powers and authority given, permitted and
granted under applicable law relative to planning and zoning in, for
and of municipalities and their environs.
Every tract of land situated within the corporate limits of
the City and its extraterritorial jurisdiction shall be platted pursuant
to the requirements and procedures of applicable law, and any ordinance,
resolution or motion by the City Council not inconsistent with such
applicable law.
The Planning and Zoning Commission shall prepare a Comprehensive
Plan for the City for submission to the City Council for adoption.
The City Council shall consider the recommendations of the Planning
and Zoning Commission for the growth, development and beautification
of the City. The City Council may adopt this plan as a whole or in
parts and may adopt any amendment thereto after at least one (1) public
hearing on the proposed adoption. Any Comprehensive City Plan approved
by City Council shall be reviewed by the Planning and Zoning Commission
every five (5) years and any recommended changes shall be submitted
to the City Council for approval, disapproval, amendment or modification.
The Comprehensive Plan adopted by the City Council shall be
used as a guide by the City Council to establish codes and ordinances
determined to be essential in providing for the public health, safety,
and welfare of the citizens of Buda, Texas, and by the Planning and
Zoning Commission to facilitate development and master plans that
the City deems necessary and appropriate for systemic growth and development.
The Comprehensive Plan shall not be nor be considered a zoning map
nor constitute zoning regulations or establish zoning boundaries and
shall not be site nor parcel specific and shall be used to illustrate
generalized locations. The depiction of thoroughfare alignments in
the Comprehensive Plan is subject to modification by the Planning
and Zoning Commission and City Council to fit local conditions and
is subject to refinement as development occurs.
The City Council shall appoint a Zoning Board of Adjustment
in accordance with applicable law. The Zoning Board of Adjustment
shall have such powers as granted under applicable law and any additional
powers which may, at the discretion of City Council, be granted.
