This Township does grant to the Authority, its successors and assigns, all easements, rights-of-way and other rights and privileges necessary and desirable in, along, over and under streets, roads, lanes, courts, culs-de-sac, alleys, public ways, public squares and other properties of this Township, together with free ingress, egress and regress therein and thereto, along with other persons having interests or rights therein, for use in connection with constructing, replacing, repairing, altering and maintaining the sewer system, as the same shall exist, from time to time.

The rights and privileges granted to the Authority under § 10-1 shall be exercised by the Authority under and subject to such reasonable rules and regulations as shall be adopted and specified, from time to time, by resolution or ordinance of this Township; and this Township does reserve the right to adopt and specify, from time to time, such reasonable rules and regulations in connection with exercise by the Authority of such rights and privileges.
This article shall become effective as provided by law.
In the event any provision, section, sentence, clause or part of this article shall be held to be invalid, such invalidity shall not affect or impair any remaining provision, section, sentence, clause or part of this article, it being the intent of this Township that such remainder shall be and shall remain in full force and effect.
All other ordinances or parts of ordinances inconsistent herewith shall be and the same expressly are repealed.

The Board of Supervisors of this Township hereby adopts and approves the amendment to the Articles of Incorporation of the Authority as proposed by a resolution duly adopted by the Board of the Authority, a copy of which resolution, duly certified by the Chair or Vice Chair and Secretary or Assistant Secretary, as appropriate, of the Authority, has been submitted to the Board of Supervisors of this Township.
The amendment to the Articles of Incorporation of the Authority, which hereby is adopted and approved, shall amend the Articles of Incorporation in order to increase the term of existence of the Authority by adding a new paragraph (G) to the Article of Incorporation, which new paragraph (G) shall read as follows:
"(G). The term of existence of said Authority shall be for a period of 50 years from the date of approval of these Articles of Amendment to the Articles of Incorporation." |
Proper officers of the Authority hereby are authorized to execute, verify and file appropriate Articles of Amendment with the Secretary of the Commonwealth of Pennsylvania and to take all other action and to do all other things which may be necessary in order to accomplish the amendment of the Articles of Incorporation of the Authority in the manner herein adopted and approved.
All ordinances or parts of ordinances, insofar as the same shall be inconsistent herewith, shall be and the same hereby expressly are repealed.
