It is the intent of this chapter to establish general regulations for the demolition of structures in Caernarvon Township, Berks County, Pennsylvania.

Prior to demolition of any structure located within Caernarvon Township, Berks County, Pennsylvania, the owner of the structure to be razed shall obtain a demolition permit from the Township Zoning Officer.
A.
Prior to issuance of a demolition permit, the owner of the structure to be razed shall complete the application for demolition of a building or structure and submit the application form to the Township with the applicable demolition permit application fee.

If any portion of the structure to be razed was built prior to January 1, 1940, the applicant shall notify the Township's Historical Documentation Agency that the structure is scheduled to be razed. The applicant is then required to allow the Township's Historical Documentation Agency to have access to both the interior and exterior of the structure that is scheduled to be razed (at a mutually agreed upon time) to photograph the interior and exterior features of the structure. The Township's Historical Documentation Agency shall be given adequate time to thoroughly photograph all features of the structure. The Historical Documentation Agency shall be given a maximum of 30 calendar days from the date of their initial contact from the Applicant to photograph the structure scheduled to be razed. The Township Zoning Officer may proceed with issuing the demolition permit if the Township's Historical Documentation Agency either:
(1)
Fails to proceed with the photographic documentation of the structure within 30 days;
(2)
Sends a letter to the Township stating that the photographic documentation has been completed; or
(3)
Sends a letter to the Township declining the opportunity to photograph the structure scheduled to be razed.
Should any section, paragraph, clause, or phrases of this chapter be declared unconstitutional or be determined to be invalid by a court of competent jurisdiction, the remainder of this chapter shall not be affected thereby and shall remain in full force and effect.
Any person violating any of the provisions of this chapter shall pay a civil penalty of $600. Each day a violation continues shall be considered an additional violation. In the event the penalty is not paid, the Township is authorized to initiate civil enforcement proceedings before a Magisterial District Judge wherein the violator may be found liable for not only the penalty stated above, but also additional penalties for continuing violations plus court costs and reasonable attorneys' fees incurred by the Township in the enforcement proceedings. In addition to these remedies, the Township is authorized to enforce the provisions of this chapter or require compliance therewith by equitable proceedings in the Court of Common Pleas of Berks County.
Any ordinance or part of ordinance in effect in Caernarvon Township conflicting with the provisions of this chapter is hereby repealed to the extent of such inconsistency.
