Caernarvon Township, Berks County, Pennsylvania, hereby adopts, for the purpose of establishing the minimum regulations governing the safeguarding of life and property from the hazards of fire and explosion arising from the storage, handling and use of hazardous substances, materials and devices; and from conditions hazardous to life or property in the use or occupancy of buildings or premises, including administration, permits and penalties, the BOCA National Fire Prevention Code, 1990, Eighth Edition, together with any and all future revisions and editions thereto as may from time to time be adopted by the Building Officials and Code Administrators International, Inc., save and except such portions thereof as are hereinafter deleted, modified or amended, as fully as if set out at length herein.

The following sections are hereby revised as follows:
A.
Section F.100.1.
The words "Caernarvon Township, Berks County, Pennsylvania" shall be inserted where the words "name of jurisdiction" appear in brackets therein.
B.
Section F.104.2.
Reword this section as follows:
It shall be the duty and responsibility of the fire department, or assistant/deputy chief, or such officer as shall be designated by the appointing authority of the jurisdiction, or the duly authorized representative, to enforce the provisions of this Code. The designated enforcement officer of this Code is herein referred to as the "Code Official."
C.
Section F.112.2.
Delete existing subsection and substitute the following:
The Board of Appeals shall be appointed by the Board of Supervisors, on an individual case basis, as required. The Board of Appeals shall consist of five residents of the municipality.
D.
Section F.112.2.1.
Delete existing subsection and substitute the following:
Each member shall meet the qualifications as established by the Board of Supervisors and shall be knowledgeable in building construction or fire prevention and control.
E.
Section F-517.2.
Subsection 1 is hereby amended to read as follows:
In all buildings of use groups A, E I.2, R.1, H, B and M.

F.
Section F.2601.2.
Delete the existing section and substitute the following:
The storage of explosives and blasting agents is prohibited within Caernarvon Township, except for temporary storage for use in connection with approved blasting operations, provided that this prohibition shall not apply to wholesale and retail stocks of small arms ammunition, explosive bolts, explosive rivets or cartridges for explosive activitated power tools in quantities involving less than 500 pounds (227 kg) of explosive material.
Should any section or provision of this article be declared by the court to be unconstitutional or invalid, such decision shall not affect the validity of the article as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
All ordinances or parts of ordinances inconsistent herewith are hereby expressly appealed.
This article shall become effective five days after the date or final passage.
