Garbage service in the city for each month shall be charged at the rates as provided for in the fee schedule found in appendix A of this code.

Monthly billing for garbage services shall be made as part of the water system billings. Payment for garbage service shall not be without payment of water, sewer, and sanitation services due. Payment for water, sewer, and sanitation services shall not be without payment for garbage service. Nonpayment of any service shall result in discontinuation of all services.

(a) 
This section shall apply to all rates and charges for garbage collection provided by the city as may be set from time to time by the city council.
(b) 
Delinquency and termination regulations shall be as established by section 13.03.005.
(c) 
The city has the authority to seek collection of the debt as allowed by law and maintains all legal remedies available.
(d) 
Upon receipt of a notice of nonpayment, customers may schedule a meeting with the city manager, who shall grant the customer an opportunity to be heard and provide any explanation for the delinquent account.

The services provided by the city for the charges provided herein shall include the collection and disposal of garbage, trash, rubbish and other refuse accumulated on premises within the corporate limits of the city, including territories annexed by the city.

The city shall not be required to provide collection and disposal of hazardous toxic or radioactive waste or substances as defined by federal, state or local law or regulation, human or animal waste, auto parts, rocks, concrete, sand, gravel, or dirt.

(a) 
Residential collection shall be once weekly. Commercial collection not requiring furnished containers (up to five (5) bags per pickup) shall be once weekly. Commercial collection with furnished containers shall be once or twice weekly, depending on the generator’s requirements.
(b) 
Each bag and/or bundle shall be placed at curbside for collection. Curbside refers to that portion of the right-of-way adjacent to paved or traveled city roadways (including passable alleys). Bags and/or bundles shall be placed as close to the roadway as practicable without interfering with or endangering the movement of vehicles or pedestrians. When construction work is being performed in the right-of-way, bags and/or bundles shall be placed as close as practicable to an access point for the collection vehicle.
(c) 
All trash, garbage, rubbish and refuse offered for collection shall be placed in plastic bags which are of suitable weight to contain the load. In no event shall any one bag offered for collection exceed thirty (30) pounds. Each plastic bag shall be adequately secured by a tie or knot.
(d) 
Tree branches and the like shall be placed in bundles not to exceed five feet (5') in length and fifty (50) pounds weight.
(e) 
Bags and bundles shall be placed at curbside by 7:30 a.m. on the designated collection day.
(f) 
The city may decline to collect any bag and/or bundle not placed or any residential refuse not in a bag approved by the city as provided herein.

When the city provides garbage collection and disposal services to third parties for special events on city property, the city shall be entitled to collect from the third party an amount equal to any additional out-of-pocket expense incurred by the city to provide the collection and disposal services.

For the purposes of this division, the following definitions shall apply:
City-controlled container.
Shall include dumpsters and/or roll-off containers placed by the city at locations throughout the city.
Person.
Shall extend and be applied to associations, corporations, firms, partnerships, and corporations as well as individuals.

(a) 
Any person or persons caught dumping trash in any garbage container other than their own will be fined in accordance with the general penalty provision provided in section 1.01.009 of this code per occurrence.
(b) 
A person who violates a provision of this division commits an offense punishable by a fine in accordance with the general penalty provision found in section 1.01.009 of this code.
(c) 
Each violation of this division is a separate offense.

A person commits the unauthorized use of containers if, with intent to avoid payment for trash, garbage, or rubbish removal services that are provided by the city, the person:
(1) 
Casts, places or deposits any trash, garbage, rubbish, refuse or any material of any description into any residential or commercial garbage or refuse container without the effective consent of the owner, tenant, lessee, or occupant of the premises which such container serves and/or is located; and/or
(2) 
Casts, places or deposits any trash, garbage, rubbish, refuse, or any material of any description into any city-controlled container.
