Upon receipt of personal property during the course and scope of his duties, the chief of police shall notify the owner thereof, if the identity of the owner is known or may be ascertained, that the property is in the possession of the chief of police and may be reclaimed.

Property which can be sold under the authority of article 18 of the Code of Criminal Procedure shall be turned over to the person designated by the city manager to schedule and hold public auctions whenever an auction has been scheduled and advertised.

Upon completion of the sale of such property, the person designated by the city manager to handle such sales shall make a report to the finance director, including the time and place of sale, the amount received for each item sold and the name and address of each purchaser. Such report, along with all funds received, shall be delivered to the finance director and deposited to the general fund of the city.

An officer or employee of the city commits an offense if he bids on or purchases, either directly or indirectly, any personal property offered for sale pursuant to the provisions of section 1.07.003 above. The prohibition contained in the preceding sentence shall not apply if the auction is conducted by an outside auctioneering firm whose fee is paid on a percentage of sales.
