The city swimming pools may be used under the regulations contained in this division.

The persons listed in this section may use the city swimming pools, to wit:
(1) 
Qualified residents of the city;
(2) 
Nonresidents who own real estate located in the city;
(3) 
Residential real property owners in those areas within the City of Dallas or Town of Highland Park which are in the Highland Park Independent School District;
(4) 
Students and teachers, sixteen (16) years of age or older, enrolled or working in day care centers located within the city limits;
(5) 
Members of any swim team, whose membership consists primarily of city residents, which has been approved by the parks director, may use the pool as a practice area;
(6) 
Members of the families and bona fide guests of qualified residents or property owners described in subsections (2) or (3) above; and
(7) 
Former mayors who are nonresidents of the city.

(a) 
Fees.
(1) 
Any person, six (6) years of age or older, entitled to use the city’s swimming pools, upon making application in person or through his authorized representative, may secure an annual permit to gain entry to the pools. The charge for this permit shall be as established by resolution of the city council.
(2) 
A day care center located in the city may purchase annual passes for its teachers and students six (6) years of age or over. The annual pass for each day care center shall be issued upon payment of a fee. Use of the pass is subject to the condition that the day care center have in attendance at the swimming pool during any time the pass is being used at least one (1) teacher for each five (5) students who are using the pool at the time. The permit is subject to the further limitation that the students and teachers may only use the pool between the hours of 10:00 a.m. and 3:00 p.m. All nonresident students of such day care centers in the city who are six (6) years of age or older shall pay a fee and shall be subject to the same time limitation and supervision ratio required for the day care center for residents.
(3) 
A qualified resident of the city may secure permission for bona fide guests to use pools by paying a cash fee for each guest each time each guest uses the pool.
(4) 
Any person entitled to use the city’s swimming pools, but not owning an annual permit (tag), may use the swimming pools upon paying a charge per person for each time the pool is used.
(b) 
Issuance of tags.
The city manager, or his representative, shall issue a tag for each family member residing at any given address within the city upon application for the same. The applicant, or his representative, must sign a receipt for the tag and a pledge that the tag will be used only by the person to whom it is issued. The tag must be worn on the swimming suit in a manner so that it can be seen by the swimming pool attendants. The day care centers shall be issued a permit or card for the teachers and students under six (6) years of age. Upon entering the pool, the designated leader of the group shall identify himself and the teachers and students coming into the pool under the permit authority.
(c) 
Lost tags.
If the tag is lost, a duplicate may be secured from the city for a fee.
(d) 
Tags not transferable.
Any person using a tag belonging to someone else may be ejected by the swimming pool attendant and the tag taken up. In such cases, the tag may be restored to the proper owner if sufficient proof is offered that the illegal use was without the owner’s permission.

Sales of tags final.
All sales of tags are final. No refunds or partial refunds shall be made to anyone, regardless of whether the purchaser has or has not used the tag, or for any other reason.

There shall be no free passes of any kind. No person shall be permitted to use the facilities or enjoy the privilege of the swimming pools without first paying the charges as herein provided.

(a) 
The opening and closing dates of the swimming pools as well as the hours of opening shall be established each year by the pool manager. The swimming pools shall be open seven (7) days a week, except when required maintenance is needed.
(b) 
In case of inclement weather, it shall be within the discretion of the pool manager or his designate to decide if the pool shall be closed.

(a) 
Special classes for swimmers may be authorized by the pool manager, and, when so authorized, subject a fee to be established by a city council resolution. Classes are limited in size. Scheduling of all swimming classes is subject to change at any time.
(b) 
An enrollment fee shall accompany the application for admission to a swimming class. In the event a person’s name is dropped from a class roster because of two (2) successive unexcused absences, an additional enrollment fee will be charged when application is made for reenrollment in any other class.

No person who has an infectious, contagious or communicable disease, a skin disorder or open sores shall use the swimming pool. The pool attendant and the police are authorized to immediately eject from the pool any person who has an infectious, contagious or communicable disease, a skin disorder or open sores, and such person shall be denied further use of the pool unless a certificate of a licensed physician is furnished certifying that such person is free of all contagious, infectious, or communicable diseases.

(a) 
Children under six (6) years of age who are qualified residents or bona fide guests of qualified residents may use any of the pools without charge when accompanied by a parent or guardian 16 years of age or older at all times.
(b) 
If the parent or guardian desires to enroll such child in one of the swimming instruction classes, an enrollment fee shall be paid for the child.

A child under six (6) years of age who is an authorized user of the city’s swimming pools under this division may use any of the pools between the hours of 9:00 a.m. and 9:00 p.m. without cost, provided the child is accompanied by a paying parent or guardian. A child six (6) years of age or older shall not be permitted to use the small pools. Only small children five (5) years of age or younger may enter (swim) in the small pools.

(a) 
The parks director is authorized to promulgate rules of conduct for persons using the city swimming pool facilities. The rules shall be reviewed and approved by the city council.
(b) 
The parks director shall post appropriate signs at the swimming pool giving notice of the rules of conduct. The notice shall include a statement that such rules are authorized by this Code of Ordinances.
(c) 
The parks director, pool manager, or person in charge of the swimming pool facilities shall have authority to enforce such rules by requiring a person violating them to discontinue use of the facilities for a specified period of time, or by ejection from the pool facilities, or by refusal of admission of the person to the pool facilities or by a means provided in section 1.09.112.
(d) 
Specific rules applicable to a particular facility of the pool, such as diving boards, water slide, and/or splash pad, shall be posted in writing on or near the facility to which they apply.

(a) 
The attendants may eject, from any pool, anyone guilty of indecent conduct, or for violation of any of the above regulations, or anyone who is so using any pool as to annoy other bathers, preventing their full enjoyment of any pool, after first having been warned by the attendant.
(b) 
The attendants may also take the tag from a violator if he continues to violate the rules after being warned, and the attendants shall deliver such tag to the city manager as soon as is practical.
(c) 
The pool manager shall investigate the conduct of such bather, and after doing so the pool manager is hereby authorized to return such tag or suspend such tag for a definite period of time or revoke such tag. If the bather objects to the ruling of the pool manager, he may appeal such decision to the parks director.
