(a) 
There have been a number of dumpsters either purchased or leased by private individuals from the City of Hallettsville, Texas, for the purpose collecting and disposing of garbage and other refuse.
(b) 
There have been a substantial number of instances where unauthorized persons have proceeded to dump their garbage and other refuse into privately owned dumpsters or dumpsters under lease to private individuals.
(c) 
Such unauthorized use of dumpsters constitutes a nuisance and a trespass to owners or lessees, and in some instances preempting the legitimate use thereof by the owners or lessees.
(d) 
Violation of this article shall constitute a class C misdemeanor and upon conviction hereof a person, firm, or any entity shall be fined in accordance with the general penalty provision found in Section 1.106 of this code. Each act shall constitute a separate offense.
