(a) 
Permit required.
Any person desiring to cut, open, or excavate any street, alley, sidewalk or other public right-of-way in the city for the purpose of installing or repairing any gas, water, sanitary sewer, telephone or electric lines, or for any other purpose whatsoever, shall first obtain a street use permit therefor from the city.
(b) 
Permit fee.
For any permittee other than a city franchisee, the fee for administration and inspection related to a street use permit shall be as provided in the fee schedule in appendix A of this code.
(c) 
Bond; insurance.
Prior to the issuance of a street use permit, the applicant shall provide to the city proof of liability insurance as set forth in section 1.26, “Insurance,” of the Standard Specifications for Public Works Construction, North Central Texas, 1983, as amended. In addition, the applicant will give good and sufficient bond in the sum of ten thousand dollars ($10,000.00), in a form to be approved by the city attorney, conditioned to conform to the regulations of this division and other ordinances or laws in reference to public works construction. The bond required under this provision shall be executed by the applicant as principal and by a corporate surety authorized to do business under the laws of the state.

When any street, sidewalk or other public right-of-way shall have been cut, opened or excavated pursuant to this division, the person performing such work shall backfill the excavation, and restore the surface to the condition in which it was found prior to the excavation. Such backfill and restoration shall be done in compliance with the standards contained in the general specifications for street construction of the city.

It shall be unlawful for any person to drive or ride upon, across or over any part of any street or alley in the city while such part of said street or alley is being paved, surfaced, excavated or repaired when such area is designated as being closed to traffic by appropriate signing erected at such place by or at the direction of the city.

It shall be unlawful for any person to cut, open or excavate any street, alley, or other public right-of-way in the city without the erection, installation and display of barricades, warning devices, and other precautionary safety measures as herein provided. Further, it shall be unlawful for any person to make any cut or excavation or perform any other work in or adjacent to such public right-of-way without the erection, installation and display of barricades, warning devices, and other precautionary safety measures as herein provided.

Any person who shall undertake to perform any work upon, in, under, above, or about any street, alley, curb, gutter, sidewalk, or any public right-of-way within the city shall, as an express condition precedent for the issuance and continuing validity of a street use permit for such work, furnish to the city, prior to the issuance of any permit for said work, a scale plat or sketch showing the work area, the space within the right-of-way required for the work, and a proposed plan for the use of barricades, signals, signs, flags, and other traffic-control and safety devices about the work area.

The city engineer may require that the work be done only at certain hours during the day or night, that materials or equipment used in such work and dirt and materials removed from any excavation be located other than adjacent to the work area where feasible, and that any excavation be covered with materials of sufficient strength and construction to permit limited vehicular traffic to pass at all times.
