The following terms, as herein defined, shall control in the
construction and enforcement of this act:
Junk
includes all worn-out, worthless and discarded material,
in general, including, but not limited to, odds and ends, old iron
and other metal, glass, paper, cordage or other waste or discarded
materials.
Litter
means garbage, refuse, and rubbish as defined herein and
all other waste material which, if thrown or deposited as herein prohibited,
tends to create a danger to public health, safety and welfare.
Public highway
means the entire width between property lines of any road,
street, way, thoroughfare, alleyway, or park in the city limits, not
privately owned or controlled, when any part thereof is open to the
public for vehicular traffic or which is used as a public recreational
area and/or over which the city council has legislative jurisdiction
under its police power.
Public place
means all streets, sidewalks, boulevards, alleys or other
public ways and any and all public parks, squares, spaces, grounds,
and buildings located within the city limits.
Refuse
includes garbage, rubbish and all other decayable and non-decayable
waste, including vegetable, animal and fish carcasses, except sewage
from all public and private establishments and residences.
Rubbish.
(1)
The term “rubbish” shall include all non-decayable
waste, except ashes, from all public and private establishments and
from all residences.
(2)
Rubbish shall consist of both combustible and non-combustible
waste, such as paper, wrappings, cigarettes, cardboard, tin cans,
yard clippings, leaves, wood, glass, bedding, crockery and other similar
material.
Vehicle
includes every device in, upon or by which any person or
property is or may be transported or drawn upon a highway, including
but not limited to automobiles, pickups, trucks, motorcycles, motor-driven
bicycles, and any and every other device used for transportation upon
a public street or public way within the city limits.

Any violation of this act by any person, firm or private corporation shall, upon conviction, subject the offender to a fine in accordance with the general penalty provided in section
1.01.009, and each day of any such violation shall be treated as a separate offense.

No person shall throw or deposit any of the heretofore described
refuse material in or upon any street, sidewalk, public highway, or
other public place within the city except in public receptacles, in
authorized private receptacles for collection, or in official city
dumps.

It shall be unlawful for any private corporation, firm or person
to dump, deposit, or leave any refuse, rubbish, litter, or garbage
on any public highway or street in the city or permit the same to
remain within or nearer than 300 yards on any public highway or street
in the city whether the refuse, garbage, rubbish, litter or junk being
dumped, deposited or left, or the land upon which refuse, garbage,
rubbish, litter or junk is dumped, deposited or left, belongs to the
person or persons so dumping, depositing or leaving it or not.
