The purpose of this chapter is to ensure the reimbursement to
the Borough of expenses incurred by its actions to abate hazardous
and dangerous conditions affecting the public health, safety, and
welfare, which include but are not limited to the following:
a. The abandonment
of dwellings or property;
b. Failure
of the owner or responsible party, firm or corporation to address
the hazard after notice of violation.

The Borough of Lakehurst is empowered and mandated consistent with N.J.S.A. 40:48 et seq., and the Revised General Ordinances of the Borough of Lakehurst Chapter
13, Housing and Property Maintenance, to take corrective action to abate and remove imminent dangers to the public health, safety and welfare. Such action may consist of the following directed to the owner, resident, firm or corporation responsible:
a. Notice
of violation with schedule date for abatement;
b. Notice
of violation with fine schedule;
c. Summons
to Municipal Court.

In the event a property is abandoned or the owner or responsible
party, firm or corporation fails or refuses to abate the hazard/danger
the Borough shall:
a. Under
the direction of the Public Works Superintendent perform the necessary
work to abate the hazard/danger.
b. Maintain
an accurate record of costs and expenses incurred by the Borough to
abate the problem, including administrative fee.
c. Transmit
a certified copy of all costs to the Tax Collector, who will forthwith
cause such costs to become a lien upon such lands and shall be added
to and become and form a part of the taxes next to be assessed and
levied upon such land, the same to bear interest at the same rate
as taxes, which shall be collected and enforced by the Tax Collector
in the same manner as taxes.
d. This cost
shall be in addition to any penalties imposed for a violation of municipal
codes.

If any section, subsection, paragraph, sentence, clause, or
phrase of this chapter shall be declared invalid for any reason whatsoever,
such decision shall not affect the remaining portions of this chapter
that shall continue in full force and effect. Further, nothing in
this chapter is designed to change, modify or nullify the right of
a hearing and appeal in any property condemnation or demolition action
taken by the Borough.
