There is created within the town a board of development appeals consisting of five members and four alternate members, who shall be resident citizens of the town, and who shall be appointed by the governing body for a term of two years beginning June 1st and ending May 31st. Any vacancies on the board shall be filled for the unexpired term of the member removing or resigning, in the same manner as initial appointments are made. Members of the board may be removed by the town council in accordance with the grounds and procedures for removal set forth in Local Government Code, section 22.077 (or any successor statute), or for missing more than three consecutive meetings without excuse. The reason for removal will be assigned in writing. The members of the board shall serve without compensation.

The board of development appeals shall act as the zoning board of adjustment and appeals, the building code board of adjustment and appeals, the plumbing code board of appeals, the electrical code board of appeals, the fire code board of appeals, the flood damage prevention regulations appeal board, the license and amortization appeal board, the appeal board for appeals from the building official regarding tree preservation, and such other boards of appeals as the town council may from time to time specifically by ordinance designate. The board of development appeals shall perform the duties of each of the boards, respectively, in the administration and enforcement of the laws and ordinances creating the same.

When sitting as a board pursuant to any of the laws and ordinances described in this division and when acting in such capacity, the board of development appeals shall be deemed to be the separate board created by such law or ordinance for the purposes therein provided and with the powers and duties thereby vested. Separate minutes and other records shall be maintained for the board, one set for each function provided in this division by it to be performed.

Notwithstanding the laws and ordinances described in this division to the contrary, the provisions of this division shall be controlling with regard to the number of board members and their method of appointment.
