Any person violating the provisions of this article shall be deemed guilty of a misdemeanor and shall be punished by a fine not exceeding $200.00, and for each day that such violation shall continue there shall be deemed a separate offense.

(a) 
As a condition precedent to the permit, approval or other consent sought, a water impact statement, as hereinafter described, shall be prepared and submitted to the town by every applicant for:
(1) 
A drilling permit for any private water well to be drilled to the depth of the Paluxy sands or deeper;
(2) 
The approval of any plat of single-family residential lots containing more than two (2) of said lots; or
(3) 
The issuance of a building permit for any multifamily residential, commercial or industrial structure.
(b) 
Provided that there shall be exempt from this requirement any application for a building permit to construct:
(1) 
A single-family residence on a lot platted prior to the effective date of this article; and
(2) 
A nonresidential building of 1,000 square feet or less to which no water supply is to be provided.

The water impact statement hereby required shall be prepared by a registered professional engineer and contain the following information:
(1) 
The estimated water consumption of the proposed development for a typical January and August;
(2) 
The criteria used in making the estimates described in subsection (1) above;
(3) 
An estimate of the annual water consumption of the development when fully developed; and
(4) 
Specific measures which may be implemented by the owner or user of the property to reduce consumption in the event that actual consumption exceeds the above-described estimates.

Each water impact statement shall, upon its submission to the town, be referred to the planning and zoning commission, which shall:
(1) 
Review and analyze the statement in terms of its content and its effects on the water resources of the town; and
(2) 
Report to the city manager, in writing, its review and analysis of the statement.

The city manager shall:
(1) 
Annually report to the citizens of the town, by newsletter and by public posting, a summary of water impact statements and the review of same; and
(2) 
Make available for examination by any interested person all water impact statements and the record of their review and analysis.
