(a) Fowl
shall be kept in a secure pen or enclosure to keep said animals from
running at-large, and shall be subject to the minimum area and distance
requirements set forth in the schedule below:

(b) It shall
be unlawful for any person to sell or offer for sale, barter, or give
away baby chicks, ducklings, or other fowl or rabbits as pets or novelties,
whether or not dyed, colored, or otherwise artificially treated; provided,
however, this subsection shall not be construed to prohibit the display
or sale of natural chicks, ducklings, or other fowl or rabbits in
proper breeding facilities for hatcheries or stores engaged in the
business of selling the same to be raised for commercial purposes.
(c) It shall
be unlawful for any person to sell or offer for sale, barter, or give
away any wild animals for the purpose of use, retention, resale, or
retransfer of such animal as a pet.
(d) Nothing
in this article shall prohibit the temporary possession of farm livestock
in the hands of packing houses or other slaughterhouses, nor shall
this chapter prohibit the temporary exhibition of farm livestock at
the fair grounds or at stock shows; however, the exemptions made in
this subsection shall not relieve the persons in charge of such farm
livestock from the operation of this code and other ordinances of
the city relative to the sanitary conditions and the noise from the
farm livestock.
(e) It shall
be unlawful for any person owning, harboring, or controlling pigeons
within the city to suffer or allow the same to go at-large within
the city, except Antwerp Messenger or homing pigeons, commonly called
"carrier pigeons," having the name of its owner stamped upon its wing
or tail, or bearing upon its leg a band or ring with the name or initials
of the owner or an identification or registration number stamped thereon
when being permitted to fly for necessary exercise and training, and
under restraint and control of its owner.
(f) It shall
be unlawful for the owner or harborer of any bull, stallion, or jack
to cause, suffer or permit the standing of any such bull, stallion,
or jack within the city for breeding purposes or otherwise, except
when conducted and carried on in a structure or building sufficiently
enclosed on all sides in all parts so as to completely shut off and
prevent all outside view or observance of same; provided, however,
that such structure or building used or intended to be used for such
purpose shall be maintained and located not less than two hundred
feet (200') from the nearest private inhabited residence of any person
other than such owner or harborer, and one hundred feet (100') from
any public street.
(g) It shall
be unlawful for any person to keep, possess or harbor fowl within
the corporate limits of the city, except on property permanently zoned
agricultural district or residentially zoned property of less than
1/4 acre.
(h) The
number, location and distance requirements of Section 2.900(a) and
Section 2.1400(a) shall not apply to a governmental entity, a public
or private primary or secondary school, or to a research institution
or special event approved by the city manager.
