(a) There
is hereby created a juvenile case manager fund for the city.
(b) A defendant
convicted of a misdemeanor offense in the municipal court in the city
shall pay a juvenile case manager fund fee as set forth in the fee
schedule in the appendix of this code for each conviction as a cost
of court.
(c) For
purposes of this article, a defendant is considered convicted if:
(1) A
sentence is imposed on the person;
(2) The
person receives deferred disposition, including deferred proceedings
under Article 45.052 or Article 45.053 of the Texas Code of Criminal
Procedure.
(d) The
judge of the municipal court may waive the fees of this article in
the case of financial hardship.
(e) The
clerks of the municipal court shall collect the costs and pay them
to the municipal treasurer or other official of the city, who discharges
the duties delegated to the municipal treasurer, for deposit in a
fund to be known as the juvenile case manager fund.
(f) The
juvenile case manager fund may be used only to finance the salary
and benefits of a juvenile case manager employed under Article 45.056
of the Texas Code of Criminal Procedure.
