All citizens of the Town of Trophy Club, in Denton and Tarrant Counties, Texas, within the boundaries of said Town now established or as hereinafter established in the manner provided by law shall continue to be a municipal body politic and corporate in perpetuity under the name “Town of Trophy Club” hereinafter referred to as the “Town” with such powers, rights, authority, privileges, obligations and immunities as are herein provided and as otherwise provided by law.
The municipal government provided by this Charter shall be known as the “council-manager government”. Pursuant to its provisions and subject only to the limitations imposed by the Texas Constitution, and the laws of the State of Texas, and by this Charter, all powers of the Town shall be vested in an elective council, hereinafter referred to as the “Council” which shall enact legislation, adopt budgets, determine policies, and appoint the Town Manager, who shall execute the laws and administer the government of the Town. All powers of the Town shall be exercised in the manner prescribed by this Charter, or if the manner be not prescribed, then in such manner as may be prescribed by ordinance or State law.
The boundaries of the Town shall be as they have been established previously, now exist, and as hereinafter amended by the Council in accordance with the law and a map of such boundaries shall be on file with the Town Secretary.
(a)
The Council shall have the power by ordinance to fix boundaries of the Town and to provide for the alteration or the extension of said boundaries, pursuant to any laws of the State of Texas now or hereinafter enacted, with or without the consent of the owners or inhabitants of such territory.
(b)
The annexation ordinance shall describe the territory to be annexed. Notice shall be published and public hearings held as required by State law. Amendments not enlarging or extending the boundaries set forth in the proposed ordinance may be incorporated into the proposed ordinance without the necessity of republication of said notice. The additional territory annexed shall be a part of the Town and the property situated therein shall bear its pro rata part of the taxes levied by the Town as provided by State law. The inhabitants thereof shall be entitled to all the rights and privileges of other citizens and shall be bound by the acts, ordinances, resolutions and regulations of the Town.
The Council may, by ordinance, disannex any territory within the corporate boundaries of the Town, if the Council determines the territory is not necessary or suitable for Town purposes or if it is determined that disannexation is required as a result of a valid municipal purpose, and may exchange territory with other municipalities. When the disannexation ordinance is passed, the disannexed territory shall cease to be a part of the Town. The disannexed territory shall remain liable for its pro rata share of any indebtedness incurred while the area was a part of the Town and the Town shall continue to levy, assess and collect taxes on the property in the disannexed territory until such indebtedness has been paid.
