A Municipal Court, known as the “Municipal Court in River
Oaks, Texas,” is hereby established. The Municipal Court shall
have the jurisdiction, powers, and duties given and prescribed by
the laws of the State of Texas. It shall also have jurisdiction of
violations of ordinances of the city enacted for the preservation
of its water system, watersheds of the city’s water supply and
the purity of the water supply, its sewer and sewage disposal facilities
and its garbage dumping grounds, whether such offenses are committed
inside or outside of the corporate limits of the City of River Oaks,
and the violations of any nuisance within five thousand feet of the
corporate limits of the city, outside of the city limits. The city
council shall have the power to create and establish by ordinance
additional Municipal Courts.
The city council shall appoint a Judge who shall be known as
the “Judge of the Municipal Court.” The city council shall
fix the compensation for the Judge. The city council shall have the
authority to remove the Municipal Judge for good cause as determined
by the city council. At the request of the Judge, a hearing shall
be held, and removal shall require an affirmative vote of the entire
city council. If for any reason the Judge is unable to act, the city
council shall either declare the office vacant, or appoint a temporary
Judge to serve until the Judge is able to act. If the office of the
Judge is declared vacant, it shall be filled by appointment by the
city council in accordance with this Section.
The city manager shall appoint a “Clerk of the Municipal
Court.” The Clerk of the Municipal Court shall keep the records
and the proceedings of the Court, issue all processes, and generally
perform all of the duties prescribed by law for clerks of such courts,
insofar as those duties are applicable.

All cases in Municipal Court shall be prosecuted by the city
Attorney or such attorneys as the council may authorize.
