(a) 
Location permit.
No mobile home may be located or emplaced anywhere within the corporate limits of the city for use as a dwelling unit and/or occupancy for any purpose unless a location permit for the mobile home has been issued by the city, and it shall be unlawful for any person to locate or emplace a mobile home or cause or permit one to be located or emplaced unless the requisite location permit has been issued for the mobile home.
(b) 
Removal permit.
No mobile home may be removed from anywhere within the corporate limits of the city unless a removal permit to remove the mobile home has been issued by the city, and it shall be unlawful for any person to remove a mobile home or cause or permit one to be removed, unless the requisite removal permit has been issued for the mobile home.

It shall be the responsibility of the mobile home owner or his or her designated agent to apply for and obtain a location permit. If the owner of a mobile home for which a location permit has been issued is not the owner of the land upon which the mobile home is to be located or emplaced, then the owner of the mobile home shall deliver a copy of the permit or cause it to be delivered to the legal owner of the land upon which the mobile home is to be located or emplaced prior to the location or emplacement thereof, except as otherwise provided.

(a) 
Application.
The application for a location permit shall contain the following information:
(1) 
The name of the company or person emplacing the mobile home.
(2) 
The name of the registered owner of the mobile home.
(3) 
The legal description, address, and owner of the location to which the applicant is intending to move the mobile home.
(4) 
A description of the mobile home, including manufacturer’s serial number, length, width, make, and year model.
(5) 
The location from which the mobile home is being moved.
(6) 
The distance the mobile home will be located from the front, back, and side space lines.
(7) 
The distance the mobile home will be located from any existing building or structure within the same space lines.
(b) 
Issuance.
Upon receipt of an application for a location permit from a mobile home owner or his or her agent, the building official shall issue an original location permit and one copy to the applicant or agent upon determination that the following listed conditions are satisfied:
(1) 
The proposed location to which the mobile home is to be moved is an approved space, meeting all the requirements of this article, all applicable zoning regulations, and all other applicable portions of the city code.
(2) 
If the mobile home is to be placed in a mobile home park, that the mobile home is to be placed on an approved space, meeting all the requirements of this article.
(3) 
If the mobile home is to be placed on a lot outside of a mobile home park, that the mobile home is to be placed on an approved lot, meeting all requirements of this article.
(4) 
If the mobile home is to be placed upon a pre-existing lot or pre-existing space, that the pre-existing lot or space has not been abandoned for use as a mobile home lot or space and is a pre-existing lot or space which has not been abandoned.

(a) 
Exception from spacing requirements.
Pre-existing lots or spaces, as defined in this article, are excepted from compliance with the spacing requirements of this article provided that:
(1) 
The lot or space is of a size that cannot comply with the spacing requirements of this article and has not been abandoned as a mobile home lot or space as defined herein;
(2) 
The size of mobile home making application for the lot or space is not greater in width or length than the mobile home being removed; and
(3) 
The mobile home being placed upon the lot or space is located equal distance from each side space line and does not create a hazardous visibility problem to vehicle traffic.
(b) 
Issuance of warning concerning failure to meet spacing requirements.
In the case of issuance of a permit to place a mobile home on a pre-existing lot or pre-existing space which does not comply with the spacing requirements of this article, a written warning shall be issued to the permit applicant and shall read substantially as follows:
WARNING: The lot or space for which you have made application to move your mobile home does not comply with requirements of the Kermit City Code. There is an increased risk of loss of life and property in case of fire due to the failure of this lot or space to meet Kermit City Code requirements.

Following approval of the application and for the purpose of defraying the administrative costs of processing the application, a fee in the amount set forth in the fee schedule in appendix A of this code shall be paid for the issuance of the location permit.
