As used in this division, the following words and phrases shall have the following meaning:
Bus.
Every motor vehicle designed for carrying more than ten (10) passengers and used for the transportation of persons; and every motor vehicle, other than a taxicab, designed and used for the transportation of persons for compensation.
Commercial motor vehicle.
Any motor vehicle designed or used for the transportation of property, not including a passenger bus, passenger automobile, panel delivery truck or pickup truck.
Motor vehicle.
Every vehicle, as herein defined, which is self-propelled.
Pole trailer.
Every vehicle without motive power designed to be drawn by another vehicle and attached to the towing vehicle by means of a reach, or pole, or by being boomed or otherwise secured to the towing vehicle, and ordinarily used for transporting long or irregularly shaped loads such as poles, pipes or structural members capable, generally, of sustaining themselves as beams between the supporting connections.
Road-tractor.
Every motor vehicle designed and used for drawing other vehicles and not so constructed to as carry any load thereon either independently or any part of the weight of a vehicle or a load so drawn.
Semitrailer.
Every vehicle with or without motive power, other than a pole trailer, designed for carrying persons or property and for being drawn by a motor vehicle and so constructed that some part of its weight and that of its load rests upon or is carried by another vehicle.
Stand.
The term “stand” as used in this division includes, although it is not limited to, the halting of vehicles for the purpose of loading or unloading property or passengers.
Trailer.
Every vehicle with or without motive power, other than a pole trailer, designed for carrying persons or property and for being drawn by a motor vehicle and so constructed that no part of its weight rests upon the towing vehicle.
Truck-tractor.
Every motor vehicle designed and used primarily for drawing other vehicles and not so constructed as to carry a load other than a part of the weight of the vehicle and load so drawn.
Vehicle.
Every mechanical device in, upon, or by which any person or property is or may be transported or drawn, including truck-tractors, trailers, and semitrailers, severally, as hereinafter defined, but excepting devices moved by human power or used exclusively upon stationary rails or tracks.

It shall be unlawful for any person or any owner to leave, park or stand any truck-tractor, trailer, semitrailer, bus, truck (other than a pickup-truck), trailer that is used primarily commercially upon any public street, alley, parkway, boulevard or other public place located within any area of the city zoned as a residential district according to the comprehensive zoning ordinance of the city; provided, that these provisions shall not apply to vehicles or equipment used by public service utility companies engaged in repairing or installing public service utilities or to buses when taking on or discharging passengers at designated bus stops or to temporary parking of a vehicle for the purpose of then loading or unloading property; provided further, these provisions shall not apply to any vehicle which becomes temporarily disabled while on the paved or main traveled portion of the aforesaid public streets, alleys, parkways, boulevards or public places in such manner and to such extent that it is impossible to avoid stopping and temporarily leaving such disabled vehicle in such location.

It shall be unlawful for any person or any owner to leave, park or stand any truck-tractor, road-tractor, semitrailer, bus, truck, (other than a pickup truck) trailer that is used primarily commercially with a rated capacity in excess of one (1) ton according to the manufacturer’s classification, upon any property located within a residential zoning district according to the comprehensive zoning ordinance of the city; provided, that these provisions shall not apply to vehicles temporarily parked for the purpose of then loading or unloading property or passengers, and shall not apply to vehicles being used by a person, firm, or corporation in performing services under a contract with the city, but not otherwise.

If any vehicle is found unattended or unoccupied and in violation of any of the provisions of this division, the fact that such vehicle is unattended or unoccupied shall be prima facie evidence that the owner unlawfully stopped, placed, stood or parked the vehicle. Proof of ownership may be made by a copy of the registration of the vehicle with the state department of public safety or the county motor vehicle license department showing the name of the person to whom the state highway license plates or motor vehicle registration were issued. This proof shall constitute prima facie evidence of ownership of the motor vehicle by the person to whom the certificate of registration was issued.

Members of the police department or their duly authorized agents are hereby authorized to remove any vehicle found parked in violation of section 12.05.032 hereof. Such vehicle shall be removed to the nearest garage or other place of safety or to a garage or parking lot designated or maintained by the police department or otherwise maintained by the city. In the event a vehicle is removed under the authority of these provisions, the owner of the vehicle shall pay, in addition to any fine assessed as a penalty for violation of these provisions, reasonable cost incurred in removing the vehicle and reasonable storage for the time the same is stored in a garage or parking lot.
