(a) 
Authority to organize a volunteer fire department be and is hereby given to citizens of the city designated by the city council. Said fire department is to be organized for the protection of life and property in the city in case of fire or any other emergency.
(b) 
Said fire department shall elect from its membership a chief, assistant chief, president, vice-president, secretary and any other officers they see fit. Elections shall be held as soon as the organizing is complete and thereafter on the first meeting night in May of each year. The officers so elected shall serve without pay. All elections shall be confirmed by the city council.

(a) 
The chief shall have control of all fire apparatus and equipment now owned by the city or that may be purchased hereafter. He shall make a report to the council of the activities of the department showing the number of fires, value of property, damage to the property, insurance collected and the net loss. In the same report, or a similar one, he shall give an inventory of the equipment and its condition. Said report is to be made in January before the succeeding chief assumes the office.
(b) 
The chief shall be in full control of all equipment owned by the city and shall in case of a conflagration have authority to conscript any equipment or supplies necessary to abate same and the city shall pay for the supplies used.
(c) 
In the absence of the chief the first assistant chief shall assume control of the department. In the absence of both the chief and first assistant chief, the second assistant chief shall be in command.

All active firemen are responsible for reporting any disability that would hinder active duty, and in cases of prolonged disability said firemen would ask to be relieved from active duty and water discounts as well as other considerations extended by the city.

Any person or persons taking or using or causing to be taken or used, any part of the property of the fire department without permission of the chief of the department, except in an actual fire or an alarm of fire shall be guilty of a misdemeanor.

(a) 
Authority.
The city hereby authorizes the fire department to bill persons and entities, including insurance companies that provide insurance coverage to said persons and entities, for the reasonable fees and costs that are related to the use, loss, damage, and wear and tear to said apparatus, tools, equipment, and materials necessary to provide the fire protection and emergency services rendered to said persons and entities in accordance with the fee schedule attached to Ordinance 85-10-25-17 as exhibit A and made part hereof for all purposes, the same as if fully copied herein. That such fees and costs are subject to the exemptions and limitations set forth in this section.
(b) 
Fees.
Fees may be collected for services provided by the department both inside and outside the city limits of the city in accordance with this section. Such fees collected shall be deposited in the reserve operating fund for the fire department. Applicable incident report information shall be utilized and forwarded to the department’s authorized agent for the collection of fees. The department or its authorized agent shall submit an invoice to the person, entity, or relevant insurance company covering the particular loss, for the emergency services rendered. If it can be reliably determined that there is no insurance coverage for a particular emergency call, which causes the department to use or incur loss, damage, and wear and tear to apparatus, tools, equipment, and materials, the department may collect such fees from the person or entity that received said emergency services or the person or entity responsible for the debts and obligations of the person or entity that received or benefited from such emergency services.

(a) 
Creation of restricted fund.
A restricted fund to be known as the fire department donation fund (the ‘fund’) is hereby established for the improvement and enhancement of the city fire department as directed by the city, and that the fund be supported by various donations as further defined below.
(b) 
Acceptance of donations.
A voluntary contribution to be known as the fire department donation fund (the ‘donation’) is hereby established and accepted for the improvement and enhancement of the city fire department, such donation to be generated by the generosity of citizens and corporations. The city council finds and determines that such donations serve a municipal purpose.
(c) 
Restrictions on fund.
Revenue collected from the donations shall only be used for the improvement and enhancement of the city’s fire department facilities, equipment and supplies. The mayor is hereby authorized to promulgate such rules and to provide for the accounting of all donations as may be reasonably necessary to effectuate the intent and policy of the city council. Additionally, the city shall dedicate any third-party gifts or contributions clearly intended to be added to the fund established and provided herein. Should the city discontinue the use of the fund or the donation, such amounts on hand and collected for the fund shall remain the property of the city and such amounts remaining in said fund shall be expended in support of the fire department as may be determined from time-to-time by the city council.
