The Planning Director is responsible for determining how a similar use is classified under the use charts.

A. 
If the Planning Director determines the use is similar to an existing use under Section 3.3.2, except that the minimum parking ratio is inappropriate, the Planning Director may apply an alternate parking ratio for the use and authorize the use under Section 3.3.2.
B. 
If the Planning Director is unable to classify the use under an existing use, the Director or the applicant may initiate an amendment to the Zoning Code (see Section 3.1.8, Amendment to Zoning Map or Text). The use is not authorized unless and until the City Council votes to approve the amendment adding the use to the use charts.

An applicant may appeal the decision of the Planning Director under this Subsection 3.3 to the Zoning Board of Adjustment in the same manner given for other administrative appeals (see Section 3.6.4).
