The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Body piercing
means the creation of an opening in an individual’s body, other than in an individual’s earlobe, to insert jewelry or another decoration.
Body piercing studio
means a facility in which body piercing is performed.
Tattoo
means the practice of producing an indelible mark or figure on the human body by scarring or inserting a pigment under the skin using needles, scalpels, or other related equipment.
Tattoo or body piercing artist
means a person who performs tattooing or performs body piercing.
Tattoo studio
means an establishment or facility in which tattooing is performed.
Temporary location
means a fixed location at which an individual operator performs tattooing or body piercing for a specified period of not more than seven days in conjunction with a single event or celebration, where the primary function of the event or celebration is tattooing or body piercing.

Any person found to be in violation of this article shall be fined as provided in section 1.01.009. Each day during or on which a violation occurs shall constitute a separate offense.

Nothing contained in this article shall be construed so as to limit, modify or amend V.T.C.A., Health and Safety Code section 146.001 et seq., and the provisions of this article are in addition to any of the requirements of V.T.C.A., Health and Safety Code section 146.001 et seq., the provisions of which are hereby adopted.

(a) 
This article does not apply to:
(1) 
A medical facility licensed under other law;
(2) 
An office or clinic of a person licensed by the state board of medical examiners;
(3) 
A person who performs only ear piercing; or
(4) 
A facility in which only ear piercing is performed.
(b) 
A person who conducts, operates, or maintains a facility, office, or clinic described by subsection (a)(1), (2), or (4) of this section is not required to obtain a license under V.T.C.A., Health and Safety Code section 146.001 et seq. to operate that facility.

The city health department, upon a routine basis, shall inspect all tattoo or body piercing studios. If a violation of this article is discovered, the health department may require the correction of such situation and make reinspections to determine compliance. Tattoo or body piercing studios shall permit inspections by the city health department during normal business hours.
