The office of fire marshal is hereby created. Such office shall
be under the direction of the fire chief, with the fire marshal reporting
directly to the fire chief. The fire marshal shall carry out those
duties as enumerated in the International Fire Code, including, but
not limited to, the inspection of all new commercial construction.

The office of fire marshal shall be the arson investigating
unit of the City, and the fire marshal shall be designated an arson
investigator as that term is used in Vernon’s Ann. C.C.P. art.
2.12(7), as amended. The fire marshal/arson investigator must obtain
and maintain certification and license as a peace officer from the
Texas Commission on Law Enforcement, or successor agency, as set out
in V.T.C.A., Occupations Code ch. 1701, as amended.
