(a) Operation of vehicle by person under the influence of intoxicating
liquor or narcotic drugs.
It shall be unlawful and an
offense for any person to drive or operate any automobile or any vehicle
upon any street or alley within the limits of the city while such
person is intoxicated or in any degree under the influence of intoxicating
liquor or narcotic drugs.
(b) Control of vehicle by person under the influence of intoxicating
liquor or narcotic drugs.
(1) It shall be unlawful and an offense for any person to be in actual
physical control or to assume control of any vehicle while such person
is in any degree under the influence of intoxicating liquor or narcotic
drugs.
(2) It shall be unlawful and an offense for any person to operate any
vehicle upon any street or alley in the city while said person is
under lawful medication if such medication is capable of rendering
said operator incapable of proper control of said vehicle.
(3) Proof that a person was sitting behind the steering wheel of a vehicle
shall be prima facie evidence that the person was in actual physical
control of the vehicle.
