(a)
Creation.
There is hereby created a San Augustine El Camino Real park board of trustees (hereinafter referred to as “park board”).
(b)
Purpose.
The object and purpose of the park board shall be to act in an advisory capacity to the city council in the formation of city policy relating to the establishment, usage and regulation of the San Augustine El Camino Real Park (hereinafter referred to as “park”); the nature of services rendered or to be rendered by the city in connection with said park; the manner in which park services and usage may be coordinated so as to be in the best interest of the public, the city and any owners of property adjoining park property; and any other such matters relating to the park as the city council may deem beneficial regarding the same.
(c)
Membership; term.
There shall be seven (7) members of the park board, each appointed by the mayor with the approval of a majority of the city council. Each such board member shall be a resident citizen and qualified voter of the city. In such appointments the mayor and the city council shall give priority consideration to such citizens as are owners of real property which adjoins or is in the close vicinity of park property. The board members shall each be appointed for a two-year term; provided, however, that of the initial seven appointments, four shall be appointed for two-year terms, and three shall be appointed for one-year terms. Thereafter, as such initial terms expire, four board members shall be appointed for two-year terms during odd-numbered years, and three board members shall be appointed for two-year terms during even-numbered years. Vacancies on the park board, occurring other than through the normal expiration of a term of office, shall be filled by appointment of the mayor with the approval of a majority of the city council, with such interim appointees to serve for the unexpired term of the board member being replaced. The board members shall be subject to removal from office by a majority vote of the city council, for any cause deemed by the city council to be sufficient and in the interest of the public. The initial terms under this enactment shall be deemed to commence to run as of the 15th day of April, 1987.
(d)
Duties.
It shall be the duty of the park board to advise the city council in the administration and supervision of the operation of the park, so as to carry out the purposes of the park board as set forth in subsection (b) of this section. Such park board may formulate, recommend and propose to the city council such rules and regulations as it may deem necessary, proper, and advisable for the orderly, lawful and wholesome use of the park by the general public and/or by specific organizations or groups of individuals. The adoption and utilization of such proposals shall remain in the sound discretion of the city council. The park board shall carry out and perform such other and further reasonable duties concerning the park as may from time to time be made and adopted by the city council.
(e)
Organization; meetings; reports.
The park board shall select from among its members a chairman, a vice-chairman, a secretary and such other officers as it may deem necessary. The park board shall hold periodic meetings at times in its discretion, with such meetings to be open to the public and in a set municipal place. If deemed necessary and advisable, the park board shall make periodic reports to the city council concerning the work of the park board and its recommendations and proposals, and shall make any other special reports as may be requested by the city council.
(f)
Limitation of applicability.
This section, and all provisions hereof, and all rights, obligations, powers and duties created hereby, shall affect and be applicable to the San Augustine El Camino Real Park property only; no other city park or public property owned or operated by the city is addressed, included or covered herein by this section and its provisions.
