A public library, which will furnish county-wide library service, available to all residents of the county, and which shall be known as the San Augustine Public Library, is hereby created, said library to be jointly established, supported and maintained by the city and the county.

A city department, to be known as the library department, is hereby created.

(a) 
Creation.
There is hereby created a San Augustine Public Library board of trustees.
(b) 
Purpose.
The object and purpose of said board of trustees is to act as an advisory and policy-making board to the city and county governments and to the librarian, in matters relating to the establishment and usage of the library or libraries, the nature of services rendered or to be rendered by the library or libraries, the manner in which the library services may be coordinated in the best interest of both the city and county, and any other such matters as the city council may deem beneficial regarding the library.
(c) 
Membership.
There shall be eleven (11) voting members of the San Augustine Public Library board of trustees. Seven (7) of such members shall be appointed by the mayor of the city with the approval of the city council. Each of such seven (7) members shall be a resident and qualified voter of the city. In addition to the aforesaid seven (7) members, there shall be four (4) members of the library board of trustees appointed by the county judge with the approval of the county commissioners. Each such four (4) members shall be a resident and qualified voter of the county, and shall have the same voting privileges and all other powers, duties and obligations as the aforesaid seven (7) members from the city.
(d) 
Officers.
The library board of trustees shall select from among its voting members a president, a vice-president and such other officers as it may deem necessary. The librarian shall serve as the secretary of the board of trustees.
(e) 
Terms; removal of members; absence from meetings.
The seven (7) city members of the library board of trustees shall each be appointed for a two-year term; provided, however, that of the first seven appointments, three shall be appointed for two-year terms and four shall be appointed for one-year terms. Thereafter, three members shall be appointed for two-year terms during the even-numbered years and four members shall be appointed for two-year terms during odd-numbered years. City vacancies on the board of trustees occurring other than through the normal expiration of a term of office shall be filled by appointment of the mayor with the approval of the city council, and such appointees shall serve for the unexpired term of the city member being replaced. The city members of the board of trustees shall be subject to removal from office by a majority vote of the city council, for any cause deemed sufficient in the interest of the public service. The initial terms under this enactment shall be deemed to have commenced to have run as of the 1st day of February, 1976. The county members of the board of trustees shall serve similar terms, with vacancies to be filled and removals effected in the discretion of the county judge and county commissioners. Any member who is absent from four meetings in a term year from February 1st through January 31st is automatically, and without further action, removed from the board of trustees.
(f) 
Duties.
(1) 
It shall be the duty of the library board to administer and supervise the operation of the San Augustine Public Library, and any branches thereof as may be hereafter established by the city council and the county commissioners court.
(2) 
Such board of trustees may formulate such rules and regulations as it shall deem necessary for the orderly use of the library facilities and for governing the performance of duties of the library employees and personnel.
(3) 
The board of trustees shall screen applications of all future librarians and make a recommendation of their selection to the city council for final approval; shall hold monthly meetings at regularly stated times, open to the public and in a set municipal place; shall receive suggestions and recommendations from the city council respecting the development of the library and library service; shall make recommendations to the city council regarding the same if deemed necessary and desirable; shall make periodic reports to the city council concerning the work of the board of trustees and any other special reports as may be requested by the city council; and shall carry out and perform such other reasonable regulations and requirements concerning said library as may from time to time be made and adopted by the city council.

(a) 
The administrative head of the San Augustine Public Library shall be the librarian, who shall be appointed by the city council and shall be a librarian by profession. The librarian shall also be the department head of the library department of the city, but in this capacity shall be under the supervision and direction of the city manager. The librarian shall receive such compensation as set and determined by the city council.
(b) 
In addition to the normal duties incident to the supervision and use of the library, the librarian shall maintain a set of books or other suitable records in which all receipts and disbursements shall be noted and a record kept of all books, periodicals, manuscripts, furniture, furnishings, instruments, apparatus or other property purchased for or donated to the library. The librarian shall have authority to maintain order in and about the library premises. Once each year the librarian shall prepare an annual report to the board of trustees and to the city council, and additionally shall submit all such reports requested by the state library. The librarian shall also prepare a budget to be submitted annually to the board of trustees for approval, and then to be submitted to the city council.

(a) 
General rules and regulations for the use and operation of the library shall be left to the direction of the librarian, with the approval of the board of trustees.
(b) 
Any person that willfully injures or defaces any book, newspaper, magazine, pamphlet, manuscript or other property belonging to the library by writing, marking, tearing, breaking or otherwise mutilating shall be in violation of this article and shall be subject to a fine in accordance with the general penalty provided in section 1.01.009 of this code.
(c) 
Any person that willfully detains any book, magazine, newspaper, pamphlet, manuscript or other property belonging to the library for thirty days after notice in writing to return the same, given after the expiration of the time which by the rules of said library may be kept, shall be fined in accordance with the general penalty provided in section 1.01.009 of this code.
(d) 
The library shall be exempt from attachment, execution and every other type of forced sale.

(a) 
The San Augustine Public Library shall be located at 413 East Columbia Street, San Augustine, Texas, and shall be a joint project of the city and the county. A copy of the resolution by the county commissioners court concerning the library is attached to Ordinance 183.
(b) 
The city shall contribute a sum of money toward the support, services, operation, increase and maintenance of said library, said sum to be determined and appropriated annually by the city council.
