A. 
The Township has incurred substantial costs to collect, transport, and dispose bulk trash.
B. 
It is the intention of this article to impose a method of securing revenue to meet, in part, the cost incurred in transporting and disposing of bulk trash. The charges herein have been fixed based upon an analysis of the costs incurred by the Township in disposing bulk trash.
C. 
The charges herein are not intended to create revenue beyond the amount necessary to cover the cost of bulk trash disposal.
As used in this article, the following terms shall have the meanings indicated:
BULK TRASH
Trash which is not generated on a daily or weekly basis from domestic residential activity. The same shall not include recyclable trash as defined in other provisions of the ordinances of Elsinboro Township.
A. 
Bulk trash shall include but not be limited to:

Carpet up to 12 feet by 15 feet

Large mattress
Oil tank (cut and cleaned out)
Dishwasher
Wooden door
Shed (bundled and tied), metal only
Console TV
Furnace
Box spring
Riding mower
Bath vanity

Couch/recliner

This list is not intended to be exhaustive but illustrative of the items included within the definition.
CURBSIDE
Location on the property to be served between the curb and the sidewalk. If no curb is constructed, it shall be the point inside the place where the curb would be located. If no sidewalk exists, it shall be the point outside the place where the sidewalk would be located and within the property. In no case shall the same include the street.
All bulk trash shall be located curbside for pickup on days designated by the Township Committee.
Bulk trash shall be placed, by 7:00 a.m. on the designated pickup day, at curbside by a residential property owner within the Township with an appropriate fee sticker attached to each bulk trash item.

The fee for disposing the bulk trash items set forth hereafter shall be $5. This list is not intended to be exhaustive but illustrative of the size and/or type of items for which said charge shall be incurred:

B. 
The fee for the disposal of the following items shall be $2. This list is not intended to be exhaustive but merely illustrative of the size and/or type of items for which said charge shall be incurred:

Barbecue grill
Lawn mower
Small machinery
Metal railings

C. 
The fee for disposal of televisions and console TVs shall be $10.

The Township Clerk shall sell stickers which shall be affixed to the aforementioned bulk trash items. The stickers may be purchased at the Municipal Building during hours of operation.
A. 
In the event an individual or entity desiring to dispose of bulk trash questions whether same is bulk trash as defined herein and/or the category in which the item falls, said individual or entity shall, before placing said bulk trash out for curbside pickup, request a hearing by the Township Committee. The hearing will be held at a regularly scheduled Township Committee meeting. The individual or entity may present evidence and witnesses and/or cross-examine the municipal official who made the initial ruling.
B. 
A request for a hearing shall be filed at least 15 days prior to a regularly scheduled Township Committee meeting. Said time frame may be waived if the Township Committee deems it appropriate and it is consented to by the objector. The notice of hearing shall not be on any specific form but shall set forth the date of the requested hearing and describe the dispute as clearly as possible.
C. 
Following the hearing, the Township Committee shall designate the disposal charge, if any. An appeal therefrom shall be taken in accordance with New Jersey Court Rule 4:69 (Actions in Lieu of Prerogative Writs).
D. 
Pending the hearing, the bulk trash shall not be picked up by the Township and shall be removed from curbside, if the same was placed thereon and not picked up.
Violations of this article shall be filed by the Zoning Officer in the Municipal Court. Upon a guilty finding, the offender shall be subject to the following penalties:
A. 
For failure to properly place the appropriate sticker upon an item and not remove same within 24 hours from 5:00 p.m. on the scheduled pickup day: a fine of not less than $50 and no more than $500 shall be imposed, together with court costs.
B. 
In the event an individual or entity is prosecuted under this section for a subsequent violation, the fine may be increased to a maximum of $1,000.
C. 
Each twenty-four-hour period following the initial time to remove the trash from curbside shall constitute a separate violation.
D. 
In the event anyone attempts to counterfeit the Township stickers, the same shall result in the Township filing an appropriate criminal charge against the individual on whose property the bulk trash with the counterfeit sticker was located. There shall be a rebuttable presumption the owner of the property was the one who affixed the counterfeit sticker. It is expressly understood that in the event a counterfeit sticker is placed on bulk trash on property owned by a corporation, the principals thereof shall be responsible; or on property which is rented, the owner thereof shall be responsible.
All ordinances or parts of ordinances inconsistent herewith are hereby repealed as to such inconsistency only.
If any provision of this article shall be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of this article as a whole or any part thereof.
