(a) 
The following words, when used in this article, shall have the meanings ascribed to them in this section:
Bag.
Plastic sacks, secured at the top, designed to store refuse with sufficient wall strength to maintain physical integrity when lifted by the top. Total weight of a bag and its contents shall not exceed 35 pounds.
Bulky item.
Furniture, freezers, refrigerators, stoves, water heaters, air-conditioning units, heating units and any other appliances or other items of like, kind, or size.
Bundles.
Items not measuring in excess of either three (3) feet in length or fifty (50) pounds in weight and which are securely fastened together.
Business day.
Any day that is not a Saturday, a Sunday, or other day on which banks are required or authorized by law to be closed in the city.
City limits.
The city’s present and future boundaries, streets, alleys, bridges and public properties, including any territories within the city’s extraterritorial jurisdiction or annexed by the city, including any territories annexed by the city, and any areas for which the city has contracted with such areas for solid waste collection, including private and/or gated communities to be provided through city.
Commercial container.
Dumpsters, dumpster compactors and roll-offs.
Commercial unit (customer).
All establishments other than residential units within the city limits.
Construction and demolition waste.
Solid waste resulting from construction or demolition activities or that is directly or indirectly the by-product of such activities, including, but not limited to, cartons, concrete, excelsior, gypsum board, metal, paper, plastic, rubber and wood products. Construction and demolition waste does not include hazardous waste, medical waste, specially handled waste, municipal solid waste or bulky items.
Container.
Any disposable container, reusable container, recycling container, or commercial container.
Customer(s).
Residential units and commercial units.
Dead animals.
Animals or portions thereof that have expired from any cause except those slaughtered or killed for human use.
Disposable container.
Any box, carton or other container intended by the residential and or commercial unit for the disposal of municipal solid waste. Total weight of a disposable container and its contents shall not exceed 35 pounds.
Dumpster.
A metal receptacle with a lid and a minimum capacity of approximately two (2) cubic yard, a maximum capacity of eight (8) cubic yards, and designed to be lifted and emptied mechanically for use only at commercial units. The service provider shall provide dumpsters to customers.
Dumpster compactor.
Any dumpster, regardless of size, which has a compaction mechanism, whether stationary or mobile. The service provider shall provide dumpster compactors to customer.
Extra trash.
Trash set out for collection not generated on a normal basis. Extra trash shall be containerized by disposal bag or a container. Extra trash does not include wet trash normally generated in a kitchen or bathroom.
Handicapped residential unit.
Any residential dwelling that is inhabited by persons, all of whom are physically handicapped to the extent that they are unable to place municipal solid waste and/or recycling at the curbside, and that generates and accumulates municipal solid waste. The service provider shall provide front door service to residential units which qualify for medical/other necessity as reasonably determined by the city, with proper documentation. The service provider cannot enter or be responsible for entering garages or behind enclosed fences.
Hazardous waste.
Waste identified or listed as a hazardous waste by the administrator of the United States Environmental Protection Agency (“EPA”) under the federal Solid Waste Disposal Act, as amended by the Resource Conservation and Recovery Act of 1976, as amended, or so classified by any federal or state statute, rule, order or regulation.
Heavy bulk.
Items such as couches, mattresses, entertainment centers, armoires, refrigerators, hot water heaters, washers, dryers, bags in excess of 50 pounds, or objects with dimensions that preventing (1) one service provider crewmember from safely loading.
Holidays.
The following days are holidays, and no waste collection services will be performed on these days:
(1) 
New Year’s Day (January 1st).
(2) 
Fourth of July.
(3) 
Thanksgiving Day.
(4) 
Christmas Day (December 25th).
Landfill.
Any facility or area of land receiving municipal solid waste or construction and demolition waste and operating under the regulation and authority of the Texas Commission on Environmental Quality (“TCEQ”) within the State of Texas, or the appropriate governing agency for landfills located outside the State of Texas.
Medical waste.
Treated and untreated special waste from health care-related facilities that is comprised of animal waste, bulk blood, bulk human blood, bulk human body fluids, microbiological waste, pathological waste, and sharps as those terms are defined in 25 Texas Administrative Code (TAC) §1.132 (relating to definitions) from the sources specified in 25 TAC §1.134 (relating to application), as well as regulated medical waste as defined in 49 Code of Federal Regulations §173.134(a)(5), except that the term does not include medical waste produced on a farm or ranch as defined in 34 TAC §3.296(f) (relating to agriculture, animal life, feed, seed, plants, and fertilizer), nor does the term include artificial, nonhuman materials removed from a patient and requested by the patient, including, but not limited to, orthopedic devices and breast implants. Health care-related facilities do not include: (1) single or multifamily dwellings; and (2) hotels, motels, or other establishments that provide lodging and related services for the public.
Municipal solid waste.
Solid waste resulting from or incidental to municipal, community, commercial, institutional or recreational activities, or manufacturing, mining, or agricultural operations. Municipal solid waste does not include any unacceptable waste or any construction and demolition waste not collected by a roll-off for disposal.
Recycling.
Materials including paper, cardboard, plastics 1 and 2, glass, and aluminum, tin and steel food containers. Recycling does not include municipal solid waste or unacceptable waste. See service provider’s solid waste and recycling brochure for more specifics. Service provider reserves the right, from time to time, to add to or delete items from the above list pursuant to section 4.A2 [sic] herein, for which no secondary market continues to exist or may be created after proper notice to the city. The service provider has no control on market values of items collected and represents no assurance of the future viability of secondary markets.
Recycling container.
Container used for residential recycling collection. Container must be a 95-gallon recycle cart with green body and black lid provided by service provider.
Residential unit (customer).
A dwelling within the city limits occupied by a person or group of persons comprising not more than four (4) families. A residential unit shall be deemed occupied when either water or domestic light and power services are being supplied thereto. A condominium dwelling, whether of a single or multi-level construction, consisting of four (4) or fewer contiguous or separate single family dwelling units shall be treated as a residential unit, except that each single-family dwelling within any such residential unit shall be billed separately as a residential unit.
Reusable container.
Service provider issued 95-gallon rolling polycart with black body and green lid displaying service provider’s logo intended by the residential unit for reuse in disposal of municipal solid waste. The container shall be no more than 95-gallons in size, and all waste placed therein must be in bags and tied off. Container must not be overfilled preventing the lid from closing fully. These containers shall remain the property of the service provider.
Roll-off.
A metal receptacle with a minimum capacity of approximately twenty (20), a maximum capacity of forty (40) cubic yards, intended for construction and demolition waste and other solid waste acceptable to the service provider and designed to be transported for disposal by loading of receptacle onto rear of a transporting vehicle. The service provider shall provide roll-offs to customers.
Sewage sludge.
Solid, semi-solid, or liquid residue generated during the treatment of domestic sewage in treatment works. Sewage sludge includes, but is not limited to, domestic septage, scum, or solids removed in primary, secondary, or advanced wastewater treatment processes; and material derived from sewage sludge. Sewage sludge does not include ash or grit and screenings generated during preliminary treatment of domestic sewage in a treatment works.
Solid waste.
As defined by the EPA under 40 C.F.R. § 261.2(a)(1) or by the State of Texas under the Solid Waste Disposal Act § 361.003(38) of the Texas Health and Safety Code, whether such waste is mixed with or constitutes recyclable materials.
Specially handled waste.
Waste that requires special handling and management due to the nature of the waste, including, but not limited to, the following:
(1) 
Containerized waste (e.g., a drum, barrel, portable tank, box, pail, etc.);
(2) 
Waste transported in bulk tanker;
(3) 
Liquid waste;
(4) 
Sludge waste;
(5) 
Waste from an industrial process;
(6) 
Waste from a pollution control process;
(7) 
Residue and debris from the cleanup of a spill or release of chemical; or
(8) 
Any other waste defined by state law, rule or regulation as “special waste.”
Unacceptable waste.
Any waste, substance or material, including solid waste, the acceptance and handling of which by service provider would cause a violation of any permit or regulatory requirement, including, but not limited to, hazardous waste, of any kind, specially handled waste (except as otherwise provided herein), medical waste, dead animals weighing ten pounds (10 pounds) or greater, solid or dissolved material in domestic sewage, or solid or dissolved material in irrigation return flows, or industrial discharges subject to regulation by permit. Unacceptable waste also includes construction and demolition waste generated by a private contractor such as (landscaping or remodeling) at residential units that is not collected with a roll-off by service provider for disposal. Other items such as auto parts, special waste, industrial wastes, toxic substances, storm debris, concrete, dirt, rocks, bricks, tile, tires, granite or stone, body wastes, radioactive waste of any kind, abandoned vehicles, fertilizers, herbicides or pesticides, pool chemicals, paint, gasoline, shingles, motor oil, cooking oil, bottles or canister for compressed gas, coals from BBQ grill, and batteries are unacceptable.
Yard waste.
Grass, grass clippings and leaves that have been collected in bags and result from general yard cleanup.
(b) 
Pronouns in the masculine gender shall include the corresponding word in the feminine or neuter gender.

Any person who shall violate any of the provisions of this article shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in accordance with the general penalty provided in section 1.01.009 of this code, and each offense and each day such violation continues shall constitute a separate offense.

The director of public works shall be the director of sanitation. The director of sanitation shall be appointed by the city council with such powers and duties as may be provided by ordinance or assigned by the mayor of the city.

(a) 
The solid waste service provider selected by the city is granted, in accordance with the city’s ordinances and regulations governing the collection, hauling and disposal of municipal solid waste, the exclusive franchise, license and privilege to collect, haul and dispose of municipal solid waste, recycle construction, and demolition waste from commercial and residential customers within the city limits. The service provider shall have the exclusive right to provide all recycling services to residential customers. The service provider shall have the exclusive right to provide recycling services to commercial customers and city facilities.
(b) 
The service provider shall be responsible for defending the rights granted to the service provider herein against third parties; provided, however, that the city shall provide all reasonable assistance to the service provider in enforcing the exclusive franchise herein against any infringing or violating waste or recycling service provider and commercial and residential customers, including without limitation, issuing citations, assessing fines and penalties and impounding any infringing third-party containers as allowed by law, rule, regulation and ordinance and taking such further action as city reasonably determines appropriate, taking into consideration the exclusive nature of this franchise, to reasonably assist the service provider with the enforcement of this franchise in furtherance of the foregoing, the city also grants unto the service provider the right to seek an injunction against any third party that is believed to be infringing on the rights of the service provider.

The following monthly rates are hereby established by the city council for solid waste and recycling collection services provided to residential and commercial customers as set out below:
(1) 
Residential unit services.
(A) 
The rate for solid waste and recycling collection services provided to each residential unit, shall be $12.15 per month for trash collection once per week, and $4.43 per month for recycling collection once per week.
(B) 
The rates for each residential unit that has a head of household aged 65 years old or older and/or handicapped residential unit, shall be $11.10 per month for trash collection once per week and $3.89 per month for recycling collection once per week.
(C) 
The rate for residential unit bulk pickup and/or extra trash collection services is $0.39 per month for collection every week.
(D) 
The rate for the annual household hazardous waste, electronic waste and shredding event service collection is $0.72.
(E) 
These rates apply to all residential units that are located within the city's corporate limits and billed by the city for solid waste and recycling services. The stated rates above do not include the applicable state and local sales tax and franchise fee. Franchise fee charges shall be based upon current franchise agreement.
(F) 
Miscellaneous fees for residential unit services:
(i) 
Extra trash:
a. 
Extra 95-gallon trash cart: $7.66 per month.
b. 
Extra 95-gallon recycle cart: $5.55 per month.
(ii) 
Special pick up for residential heavy bulk (less than 100 pounds): $122.06 per pickup. Heavy bulk (100 pounds or more): $194.19 per pickup.
(2) 
Commercial unit services.
The rates for solid waste and recycling services provided to each commercial unit per month, for each container utilized, are as follows:

Casters: $35.51 per set of four casters per month.
(ii) 
4" Legs: $12.20 one-time charge.
(iii) 
Locks: $12.20 per lock per month.
(iv) 
Enclosures/gates: $12.20 per enclosure/lift.
(v) 
Delivery fee for containers: $110.96.
(vi) 
Removal fee for containers: $110.96.
(vii) 
Dry run fee: $166.44.
(viii) 
Recycle contamination: $214.10 per occurrence.
(ix) 
Solid waste account deposit: $250.00 applies to solid waste only accounts.
(E) 
Applicability; sales tax.
The foregoing rates apply to all commercial units, or residential units using commercial roll-offs and/or compactors, that are located within the city's corporate limits and billed by the city for solid waste and recycling services. The stated rates above do not include the applicable state and local sales tax, or franchise fees of 15%.

(a) 
The owner, occupant, tenant or lessee of any residential or commercial premises in the city shall have garbage, trash and rubbish regularly removed by the city selected solid waste provider.
(b) 
The charges for such service shall be included on the monthly bill of the customer, as determined by the utility deposit or service application.
(c) 
All services may be suspended upon failure to pay the required charges within ten days from the due date of the bill, and it shall be unlawful for any person to accumulate garbage, trash or rubbish on his premises in a manner making same uncollectible by the city/provider, or to prevent such collection.

(a) 
Each owner, occupant, tenant or lessee using or occupying any building, house or structure within the corporate limits of the city for residential or commercial purposes shall maintain suitable containers or receptacles of sufficient size and number to hold the garbage, trash and rubbish which normally accumulates on the premises. When special conditions exist which subject containers so placed to overturn in spillage, the sanitation division may, at its discretion, require such containers subject to overturn and spillage to be placed in a portable, movable or stationary rack.
(b) 
Garbage and recycle containers are provided by the city through third-party contract services. Damages and/or replacements are at the expense of the user.

(a) 
The required residential receptacle for trash and rubbish shall be placed on the curbline most accessible to the sanitation collection crew, or on the alley line where applicable.
(b) 
The locations may be specified at the discretion of the city.

It shall be unlawful for any person to sweep, haul, throw, or deposit any garbage, trash, dirt, concrete, rocks, brick, plaster, tile, stagnant water, or dead animal into, upon, or along any drain, gutter, alley, sidewalk, parkway, street, or vacant lot, or upon any public or private premises within the corporate limits of the city.

The lids or covers of all garbage and trash containers shall at all times be kept secure and fastened so that flies and other insects may not have access to the contents thereof. Such lids or covers shall only be removed while the containers or receptacles are being filled or emptied, are the case may be.

In the event trash is of such a nature that it cannot be put in the regulation containers, it shall be placed in neat and orderly piles, and placed adjacent to the containers, in order that it may be removed conveniently. Refrigerators and AC units must be tagged with a Freon evacuation certificate issued by a licensed agent, hot water heaters must be drained, carpet and flooring must be cut into no more than 4' lengths and tied in bundles, with a limit of six bundles per pickup day. Bulk shall not exceed 50 pounds and not concrete is allowed. Trash collected under this section shall not exceed four cubic yards by volume, on any one collection day. Provided, however, that it shall be unlawful for any person to place trash in an alley or street so as to obstruct or hamper vehicular or pedestrian traffic.

In the event trash is of such a nature that it cannot be put in the regulation containers, it shall be placed in disposable containers or in neat and orderly piles, and placed adjacent to the containers, in order that it may be removed conveniently. Tree limbs and hedge clippings shall not exceed three feet in length, cut and tied into 3'x3'x3' bundles not exceeding 50 pounds each. Trash collected under this section shall not exceed four cubic yards by volume, on any one collection day. Provided, however, that it shall be unlawful for any person to place trash in an alley or street so as to obstruct or hamper vehicular or pedestrian traffic.

Dogs, cats, or any other dead animals shall not be placed in garbage or trash containers. The dead animal pickup service of the city will, upon notice to do so, remove such small dead animals.

Rock, dirt, concrete, brick, tile, plaster, waste, scrap building materials, or other trash resulting from construction or major remodeling, resulting from a general cleanup of vacant or improved property just prior to its occupancy, or resulting from sizable amounts of trees, brush, and debris cleared from property in preparation for construction, will not be removed by the city as regular service. The owner will have such debris removed at his expense.

It shall be the duty of any person employing, engaging, or otherwise paying a contractor, student, professional tree trimmer, or any other person to trim and prune his trees or shrubs to have the trimmings and debris removed at the owner’s expense. The city will not remove trimmings and debris created by such persons as regular service.
