All surplus property shall be sold at a public auction by an
auctioneer that is licensed by the state.

The city council shall approve the list of items to be sold
by auctioneer. This list shall be provided to the auctioneer not less
than 15 working days prior to the sale date.

The list of items that are to be sold along with the time, date,
location of sale, and any minimum acceptable price shall be posted
at the city hall in full public view not less than 10 working days
nor more than 30 working days prior to date of the sale.

The city council may reserve the right to set and establish
minimum acceptable prices that the city is willing to accept for the
sale of specific items. Should the city council choose the option
of setting a minimum bid on any item, the item shall be uniquely identified,
and the minimum price shall be supplied to the auctioneer prior to
the start of the sale.

For the purpose of this article, surplus property includes those
items which are no longer necessary, are not required, or whose ownership
does not promote or improve the general well-being of the city, but
does not include items routinely discarded as waste.

Items that are disposed of by “trade-in” on new
or used equipment are excluded from the terms of this article.

The auctioneer shall provide the city a record of each item
sold and the sale price of each item. The city shall keep a record
of each [item] of surplus or salvage property sold and the sale price
of each item. The city shall also keep a record of each item of surplus
or salvage property destroyed.

If the city undertakes to sell any item as surplus property
or salvage property by auction under the terms of this article and
is unable to sell the item because no bids are made, the city council
may order the property to be destroyed or disposed of as worthless
salvage.

If a purchaser of surplus or salvage property at a sale held
in accordance with this article complies in good faith with the conditions
of the sale and applicable rules of the city, the purchaser obtains
good title to the property.
