Garage sale.
The sale of tangible personal property or used or unwanted
household items that is held in the garage, driveway or yard of the
seller’s residence. The term garage sale includes the terms
yard sale, estate sale, occasional sale, and similar terms.

No permit shall be issued by the city to conduct a garage sale
on property zoned commercial or being used as a commercial business.

A permit shall be required and obtained prior to conducting
a garage sale. The permit may be issued to the owner or tenant of
the residence.

If any person is cited for violation of this article, two or
more times during any calendar year, the city may refuse to issue
that individual a permit to hold a garage sale any time during the
subsequent calendar year.

The number of garage sales on a property shall not exceed four
(4) during any calendar year period from January 1st to December 31st
and not to exceed one per calendar month. The duration of each sale
shall not exceed three (3) consecutive calendar days. Garage sale
items shall not be allowed to be left out between each garage sale.

Tangible personal property shall be sold only on the premises
of the owner or tenant where the sale is conducted. Said owner or
tenant must be the legal owner of such tangible personal property
at the time of such sale. The items for sale shall be confined to
the garage, porch, patio or yard on the premises of the residence.
No new merchandise, (i.e. merchandise acquired solely for the purpose
of resale), shall be sold at a garage sale.

If a property owner or tenant has purchased a garage sale permit,
and the majority of the scheduled dates for the sale are affected
by rain or other inclement weather, as determined by city staff, a
rain-out permit may be issued at no cost, provided the property owner
or tenant returns the original permit. The new permit must be issued
within thirty (30) days of the date of the original permit. If the
permit was issued for two (2) or three (3) days and the rain or inclement
weather affects only one (1) day during the permit period, a rain-out
permit shall not be issued.

In the event of multiple garage sales in one community, ( i.e.
a subdivision), each property owner participating in the event will
be required to obtain a permit.

(a) Signs issued exclusively by city.
Signs advertising
the garage sale shall be limited to signs issued by the city. With
each garage sale permit, the applicant will be issued a total of three
signs, including one yard sign and two directional signs. No other
signs may be posted or used by the holders of the garage sale.
(b) Sign locations.
The garage sale permit holder shall
use the signs issued by the city subject to the following regulations:
(1) The yard sign shall be posted on the property of the garage sale
in a conspicuous location;
(2) The two directional signs may be placed on private property with
permission from the property owner, to aid the public in locating
the sale. The permission of the property owner must be indicated by
the property owner’s signature on the back of the sign;
(3) Signs shall not be placed on utility poles, street sign poles, or
other fixed objects in the city or state rights-of way; and
(4) Signs shall not be placed within a street median or visibility triangle.
(c) Removal of signs.
Signs shall not be posted more than
twenty-four (24) hours prior to the beginning of the sale. The signs
advertising a garage sale shall be removed by the garage sale permit
holder not later than twenty-four (24) hours following the expiration
of the garage sale permit.

Any person, firm, association or persons, company, corporations
or their agents or employees violating or failing to comply with any
of the provisions of this article shall be fined, upon conviction,
not less than one dollar ($1.00) nor more than five hundred dollars
($500.00) and each day any violation of noncompliance continues shall
constitute a separate and distinct offense. The penalty provided herein
shall be cumulative of other remedies provided by state law, and the
power on injunction as provided by V.T.C.A. Local Government Code
54.012 and as may be amended, may be exercised in enforcing this article
whether or not there has been a complaint filed.
