There shall be and is hereby created a city planning and zoning
commission for and in the city.

(a) Number of members.
The planning and zoning commission
shall consist of five (5) members, each of whom shall be duly appointed
by the city council.
(b) Appointment, qualifications and term of members.
Members
of the commission shall be resident citizens and qualified voters
of the city, appointed by the council for a term of three years.
(c) Transitional terms.
(1) Currently sitting members shall be reappointed along with the appointment
of the newly created member according to the following terms: Two
(2) members shall hold office for a term of three (3) years, two (2)
members shall hold office for a term of two (2) years, and one (1)
member shall hold office for term of one (1) year.
(2) Upon the expiration of the initial terms of office, members shall
be appointed for a term of three years.
(3) A chairperson and vice-chairperson shall be elected at the first meeting after appointment to serve until January 1, 2009, and thereafter elected as provided in subsection
(d).
(d) Chairperson and vice-chairperson.
There shall be a chairperson
and vice-chairperson, elected by the members at the first planning
and zoning commission meeting held after January 1 of each year for
a term of one year. The chairperson and vice-chairperson of the commission
may serve consecutive terms.
(e) Removal of members; attendance.
(1) Members of the commission may be removed by the city by a majority
vote of the city council for inefficiency, neglect of duty or malfeasance
in office.
(2) Any member having three consecutive unexcused absences shall have
his membership reviewed by the commission. By favorable vote of three
(3) of the commission members, the commission may recommend to the
council that such member be removed from office. The council may then
act upon such recommendation, and either remove or retain such member.

The city planning and zoning commission shall adopt such rules
and regulations as it deems best, subject to the ordinances of the
city, for the practical and efficient transaction, of business, and
keep records of its findings, and determination, which record shall
be a public record. At least one (1) meeting per month shall be held
and additional meetings may be held from time to time upon the call
of the chairman.

(a) The
city planning and zoning commission shall make, or cause to be made,
and adopt a master plan for the city, including any area outside of
its boundaries which may relate to the comprehensive planning of the
city.
(b) The
master plan, with the accompanying maps, plats, charts and descriptive
matter, shall show the city planning and zoning commission’s
recommendations for the development of said territory, including,
among other things, the general location, character and extent of
streets, viaducts, bridges, railroads, terminals, parks, parkways,
playgrounds, aviation fields, athletic fields, school grounds, or
public improvements, and the removal, relocation, widening or extension
of such public works that exist. As the work of making the whole master
plan progresses, the city planning and zoning commission may from
time to time adopt and publish a part or parts thereof. The city planning
and zoning commission shall from time to time alter, amend, extend
or add to the plan.
(c) In
preparation of such plan the city planning and zoning commission shall
make careful and comprehensive surveys and studies of present conditions
and future growth of the city and with due regard to its relation
to neighboring territory. The plan shall be made with the general
purpose of guiding and accomplishing a coordinated, adjusted and harmonious
development of the city and its environs which will, in accordance
with present and future needs, best promote health, safety, morals,
order, convenience, prosperity and general welfare, as well as efficiency
and economy in the process of development, among other things, adequate
provision for traffic, the promotion of safety from fire and other
dangers, adequate provision for light and air, the promotion of the
healthful and convenient distribution of population, the promotion
of good civic design and arrangement, wise and efficient expenditure
of public funds, and the adequate provision of public utilities and
other public requirements. Such plan as approved by the city planning
and zoning commission shall be presented to the city council for its
ratification and acceptance.

Whenever the city council shall have adopted a master plan recommended
by the city planning and zoning commission, no public buildings, streets,
subways, viaducts, bridges, railroads, terminals, parks, parkways,
playgrounds, aviation fields, athletic fields, school grounds, fire
station sites, or other public grounds or public improvements, or
part thereof, shall be constructed within areas affected by said plan,
until and unless the location thereof shall be recommended by the
city planning and zoning commission and approved by the city council.
Provided, however, that, in case of its disapproval, the city planning
and zoning commission shall communicate its reason for disapproval
to the city council, and thereupon the city council shall either permit,
or refuse to permit, such improvements to be made. The widening, narrowing,
ornamentation, vacancies, or change in the use of streets and other
public ways, public grounds, or other public improvements appearing
on the adopted plan shall be subject to similar recommendation by
the city planning and zoning commission. The city planning and zoning
commission may make recommendations to any public authorities or to
any corporations or individuals in the city or in the territory contiguous
thereto, concerning the relocation of any building, structures or
works to be erected or constructed by them.

The city planning and zoning commission shall act in an advisory
role to the city council on matters of zoning changes that are presented
to it from time to time.

All plans, plats or replats of land laid out in building lots,
into streets, alleys, or other portions of the same intended to be
dedicated to public use, or for the use of purchasers or owners of
lots fronting on or adjoining and located within the corporate limits
and [extraterritorial jurisdiction] of the city shall be submitted
to the city planning and zoning commission for approval, after which
they must first be ratified and accepted by the city council before
any connection shall be permitted with any public utility, such as
water and sewers, owned and operated by the city. No sewer or water
improvement shall be voted on or made, nor shall any public money
be expended within any lands laid out in building lots, streets and
alleys, until the plan, plat or replat of such lands shall have been
approved by the city planning and zoning commission and ratified and
accepted by the city council; provided, however, that if the city
planning and zoning commission shall not make such recommendations,
it shall communicate its reasons therefor to the city council, and
the city council, if it sees proper, may take other action with respect
to such.

The city planning and zoning commission shall make the city
council an annual report, submitted during the month of January of
each year, giving a statement of its work during the preceding year.
In such annual report it shall also make its recommendations as to
future projects to be undertaken, and from time to time it shall also
make like recommendations for public improvements which, in its judgment,
should be undertaken.
