For the purposes of this article, the following words, terms and phrases shall have the meanings herein set out.
Applicant.
A person who applies for a permit under this articles, includes all persons residing at the address of the location where the temporary sale is to be held.
Occasional sales.
Offering for sale of personal and/or household property belonging to or in the possession of the person conducting the sale. Said sales shall include “yard sale,” “patio sale,” “plant sale,” “sample sale,” “rummage sale,” “flea market,” “estate sale,” or any similar casual sale of tangible personal property, which is advertised by any means whereby the public at large is or can be made aware of such sale.

(a) 
A permit shall be obtained from city hall for such occasional sales at no charge to the applicant.
(b) 
The applicant shall provide the name of the person having the occasional sale, driver’s license number, the address of the occasional sale and the dates on which the occasional sale will be held.
(c) 
An occasional sales canceled due to weather will not count against the limit of four sales per calendar year.
(d) 
The owner or lessee must be the legal owner or acting as agent with another legal owner of such tangible property at the time of sale.
(e) 
No new merchandise or merchandise acquired for the purpose of resale, shall be sold at such occasional sale.
(f) 
The duration of each sale shall not exceed three (3) consecutive calendar days.
(g) 
No person may hold an occasional sale, or receive a permit for same, at the same property address more than four (4) times per calendar year.

The provisions of this article shall apply to regulations for occasional sales and sign regulations established herein and shall be enforced by the city immediately upon the effective date of this article. Separately adopted ordinances may also address applicable requirements and services provided within the city. This article should not be construed to be all inclusive of any other city regulations within the city. The regulations are subject to change to reflect the best interest of the citizens and as such, the regulations herein may be changed or amended by the city council at any regular or scheduled public meeting through a simple majority vote.

(a) 
One (1) occasional sale sign is permitted, not to exceed three (3) square feet, upon the property where the occasional sale is taking place.
(b) 
Two (2) directional signs at a remote location, not to exceed three (3) square feet, shall be permitted.
(c) 
Signs may be placed at any location in the city with permission of the owner or the lessee of the property upon which it is to be placed.
(d) 
Placement of signs upon public property, utility poles, easements, and public rights-of-way is prohibited.
(e) 
No sign shall be displayed more than 48 hours in advance of the garage sale, and all signs must be removed within 24 hours of the end of the garage sale.

Nonprofit organizations are exempt from the requirements set forth in this article, except for the sign requirements.

Any person, firm or corporation violating any provision of this article shall be deemed guilty of a misdemeanor and upon final conviction thereof fined in an amount not exceeding five hundred dollars ($500.00) for all other violations, provided, however, that no penalty shall be greater or less than the penalty provided for the same or similar offense under the laws of the state. Each and every day any such violation continues shall constitute a separate offense punishable hereunder.
