The 2009 edition of the International Building Code and the 2009 edition of the International Existing Building Code, each of which is published by the International Code Council, are hereby adopted by the city council for the purpose of establishing rules and regulations governing building and building activities within the corporate limits of the city. A copy of each is now on file in the office of the city secretary in the permanent files of the city, and such codes are incorporated as fully as if set out at length herein, and the provisions thereof shall be controlling within the corporate limits of the city.

In the event of any conflict between the provisions of the codes adopted by this division and applicable provisions of this Code of Ordinances, state law or city ordinances, rules or regulations, the provisions of this Code of Ordinances, state law or city ordinances, rules or regulations shall prevail and be controlling.

(a) 
Whenever the word “municipality” or the word “city” is used in the codes adopted by this division, it shall be construed to mean the city.
(b) 
Whenever the term “corporate counsel” or “city attorney” is used in the codes adopted by this division, it shall be construed to mean the city attorney of this city.

Any person who shall violate any provision of the codes adopted by the provisions of this division shall be deemed guilty of a misdemeanor and shall be punished in accordance with the general penalty provision set forth in section 1.01.009 of this code. Each day such violation continues shall be deemed a separate offense.

The city may require the payment of fees to offset the costs of plan review and construction inspection under this chapter. The applicable fees are set forth in the fee schedule found in appendix A of this code, and may be updated periodically by the city council.
