The following words, terms and phrases, when used in this article,
shall have the meanings ascribed to them in this section, except where
the context clearly indicates a different meaning:
Garage sale.
A sale or an offer for sale of miscellaneous items to the
general public, upon residential property not otherwise being used
for commercial purposes.
Occupant.
Either the owner-occupant of the premises whereon such sale
is to be conducted, or the tenant of the owner, provided such tenant
is actually residing upon such premises, and dependent members of
the immediate family of such owner-occupant or tenant.

It shall be an offense for any person to conduct a garage sale in violation of this article. Each violation under this article is a misdemeanor offense punishable upon conviction by a fine in an amount in accordance with the general penalty provided in section
1.01.009 per offense.

It shall be required for any person to file an application first
before engaging in a garage sale within the city. An application must
be filed each time a garage sale is to be held.

The application must be filed with the city secretary on a form
furnished by the city secretary, which shall give the following information:
(2) Address
of the applicant;
(3) The
place where the garage sale is to be held;

The city secretary shall issue the permit to the applicant,
who shall display the permit at all times during the garage sale.

(a) Each
application shall be for one garage sale only. A garage sale may not
continue for more than three consecutive days beginning with the date
of the permit. Should the sale be rained out and not be able to occur,
the sale may be held the following week under the same permit. Should
the rain-out date also be rained out, the permit holder must contact
the city to request a new permit. No person other than an occupant
of a property shall conduct a garage sale on the property.
(b) Garage
sales are limited to four sales per year, one per quarter, at the
same address by the same applicant during a calendar year.

(a) The
hours of operation of a garage sale shall be from 8:00 a.m. to 6:00
p.m.
(b) Sale
items are limited to the resident’s personal goods. The resale
of merchandise is prohibited.
(c) Signs
may not be erected, posted, or attached to any public property such
as trees, utility poles and medians. Signs may be posted on private
property with the owner’s permission.

The city secretary shall keep a record of all applications filed
for five years.

of the city secretary.
