Fireworks means and includes any combustible or explosive composition
or any substance or combination of substances or devices prepared
for the purpose of producing a visible or an audible effect by combustion,
explosion, deflagration or detonation and shall include blank cartridges,
toy pistols, toy cannons, toy canes or toy guns in which explosives
are used; firecrackers, torpedoes, skyrockets, Roman candles, sparklers
or other devices of like construction; and any devices containing
any explosive or flammable compound or any tablet or other device
containing an explosive substance, except that the term “fireworks”
shall not include any auto flares, paper caps containing not in excess
of an average of twenty-five hundredths (0.25) of a grain of explosive
content per cap, and toy pistols, toy canes, toy guns or other devices
for use of such caps, the sale and use of which shall be permitted
at all times.

No person shall cast, throw or fire any fireworks of any kind
within the city limits. It shall be unlawful for any person to possess,
store, give away, use or explode any fireworks within the city limits.

No person shall manufacture, assemble, store, exhibit or have
in his possession, with intent to give away or sell or offer for sale
or sell within the city limits, any fireworks of any kind. The fire
marshal or his designate shall seize, take, remove or cause to be
removed, at the expense of the owners, all stocks of fireworks offered
or exposed for sale, stored or held in violation hereof.

Nothing in this article shall be construed to prohibit the use
of fireworks by railroads or other transportation agencies for signal
purposes or illumination or the sale or use of blank cartridges for
a show or theater or for signal or ceremonial purposes in athletics
or sports or for use by military organizations or to the sale, storage
or use of flashlight composition by photographers or dealers in photographic
supplies or prevent any public or private demonstration or display
of fireworks of any kind if conducted under the supervision of the
fire marshal after application is made and a written permit is issued
by the fire marshal for such demonstration or display. Such permit
shall not be granted until written application therefor has been filed
with the fire marshal nor unless such demonstration or display shall
be of such character and so located, discharged or fired as, in the
opinion of the fire marshal, shall not be hazardous to property or
endanger the public safety.

The fire marshal or his designate shall have the authority to
seize, take, remove or cause to be removed, at the expense of the
owner or person in charge, fireworks offered or exposed for sale,
stored or held in violation hereof. The fire marshal shall dispose
of in any safe way any such fireworks confiscated.
