There shall be established a Planning and Zoning Commission
which shall consist of five (5) citizens from the City of Coleman.
Such members shall be residents of the City of Coleman and shall be
registered voters. The members of said Commission shall be appointed
by the City Council for a term of two (2) years. The City Council
shall initially appoint three members for two-year terms, and two
members for one year terms. At the end of the first year, members
will be appointed for full two-year terms producing a schedule of
alternating terms. The Commission shall elect a Chair and Vice Chair
from among its members. The Commission shall meet as required. Vacancies
and unexpired terms shall be filled by Council appointments for the
remainder of the term. A majority of the members shall constitute
a quorum, and the affirmative vote of three (3) members shall be necessary
for passage of any recommendation to the City Council. Members of
the Commission may be removed by the Council, after public hearing.
The Commission shall keep minutes of its proceedings which shall
be of public record. The Commission shall serve without compensation.
Commission members and officers holding such office on the effective
date of the Charter shall continue in office until the expiration
of their term of membership or office, and shall thereafter be appointed,
as provided in this Section.
The Planning and Zoning Commission shall recommend to the City
Council approval or disapproval of proposed changes in the Zoning
Ordinance, Master Plan and, Master Thoroughfare Plan, and shall review
and recommend approval or disapproval of all subdivision plats.
In order to over-ride any recommendation of the Planning and
Zoning Commission, a vote of four (4) members of the City Council
shall be required.
The Commission shall be responsible to act as an advisory body
to the Council and shall have and perform such additional duties as
may be prescribed by ordinance.
A Master Plan for the physical development of the City of Coleman
shall be adopted by the City Council and it shall contain recommendations
for growth, development, and beautification of the City.
The City Council shall have the authority to amend the Master
Plan in whole or in part after two public hearings on the proposed
action.
Upon the adoption of a Master Plan by the City Council, no subdivision,
street, park, or any public way, ground or space, public building
or structure, or public utility, whether publicly or privately owned,
which is in conflict with the Master Plan shall be constructed or
authorized by the City until and unless the location and extent thereof
shall have been submitted to and approved by the City Council. The
widening, narrowing, relocating, vacating, or change in the use of
any street, alley, or public way, or ground; or the sale of any public
building or real property, shall be submitted for approval to the
City Council.
