(a)
Prohibition; violations by minors.
No person shall demonstrate, cast, throw or fire any fireworks within the city limits during a burn ban. The commission of such offense by a minor in the presence of a parent or guardian, or on any property under the control of or owned by a parent or guardian of said minor, shall be prima facie proof that the relation or guardian was instigating or aiding the minor. In such instance the parent or guardian may be charged with said violation.
(b)
Definition.
“Burn ban” means a properly enacted order restricting outdoor burning by the city council and/or a specific ban on burning enacted by the county commissioners’ court.
(c)
Penalty.
Any person who shall violate any of the provisions of this section, or suffer or allow the same to be violated, shall upon conviction therefor be subject to a fine of not more than five hundred dollars ($500.00).
