The owner and/or developer of any property within Lower Windsor
Township which contains any private community road and/or unadopted
street shall maintain such private community road and/or unadopted
street so as to ensure that vehicular traffic can reasonably navigate
the roadway without obstruction and in a safe manner that does not
risk injury or damage to a vehicle. Owners of private community roads
and/or unadopted streets shall ensure the following: roadways shall
be surface graded or resurfaced at intervals to ensure appropriate
passage of vehicles; shall be maintained substantially free of potholes;
shall have appropriate drainage systems in place which ensure stormwater
does not pond on the roadway; shall maintain unobstructed vision at
any intersection regardless of whether the intersection is an intersection
of public or private roads; shall ensure dust-control measures are
employed, and shall ensure that grass and weeds are appropriately
controlled so as not to encroach into the path of travel. Notwithstanding
the foregoing, the Code Official may, in consultation with the Township
Engineer, determine that vehicular travel on a roadway is impeded
due to potholes or other obstructions. Should the Code Official, in
consultation with the Township Engineer, determine that vehicular
travel is impeded on a roadway due to potholes or other obstructions,
such impediment shall be a violation of this chapter.
The owner and/or developer of any property within Lower Windsor
Township which contains any private community road or unadopted street
shall remove any snow and ice from a private community road or unadopted
street within 12 hours of the time any snowfall or accumulation of
ice occurs. If ice is so thick as to make removal impractical, the
owner or developer shall cause each roadway to be thoroughly covered
with sand, rock salt, antiskid material or similar product within
12 hours after the accumulation of ice.
Notwithstanding the requirements set forth in §§
310-3 and
310-4, if it is determined that any private community road or unadopted street is in a state of disrepair such that police, fire, ambulance, or other emergency vehicle travel is impeded, or that such emergency vehicles cannot safely or expeditiously travel the roadway, it shall be in violation of this chapter. Such a determination shall be requested by the chief of the emergency department which believes travel of emergency vehicles on the roadway is impeded and shall be made by the Township Engineer.
