(a) 
Permit required.
Any person intending to perform any activity upon any lot or piece of land located at the city cemetery, including the inscription of the last date on headstones, shall obtain a permit from the city secretary.
(b) 
Application for permit.
Each person or company desiring a permit shall submit an application to the city secretary which shall include the following:
(1) 
The name of the person or company (“applicant”);
(2) 
The mailing and physical address of the applicant;
(3) 
The telephone number of the applicant;
(4) 
The telephone number of the owner of the lot and the description of the lot;
(5) 
Payment of a staking fee in the amount set forth in the fee schedule in appendix A of this code.
(c) 
Performance of work.
Following the issuance of a permit, the work must be performed in accordance with the following:
(1) 
Prior to any work being performed the permit holder must contact the city at least 24 hours in advance and request that the corners of the lot be staked.
(2) 
No work may be done before 8:00 a.m. or after 5:00 p.m. without the prior permission of the city administrator or his designee.
(3) 
No work may be done on Saturday, Sunday or any holiday recognized by the city.
(4) 
All work shall cease upon entry of a funeral procession into the cemetery and shall not resume until such time as the grave has been closed.
(d) 
Exceptions.
The following are specifically excepted from the permit requirement:
(1) 
Cleaning and maintenance of a grave site; and
(2) 
Placement of floral arrangements.
(e) 
Unreasonable noise.
All persons performing activities in the cemetery shall take care to assure that their activities do not result in excessive or unnecessary noise such as would disturb a person of reasonable sensibilities.
(f) 
Enforcement.
Any person violating the provisions of this section may be removed from the cemetery. In the event any person or company repeatedly violates the provisions of this section, the city administrator may, in his discretion, refuse to issue the violator additional permits. The city administrator’s refusal to issue further permits may be reviewed by the city council at the request of the applicant.
