“Block party,” as used herein, shall refer to the closure of not more than one (1) block of a city street from traffic for the purpose of celebration or gathering by the residents of the city.

Block parties shall not be held unless a permit shall have been obtained from the city manager in accordance with this division.

The person(s) seeking issuance of the required block party permit shall file an application with the city manager on forms to be provided by the city manager.
An application for the block party permit required herein shall be filed with the city manager not less than ten (10) days nor more than thirty (30) days before the date on which it is proposed to hold the block party.
A petition, signed by all residents of the block on which the party is intended, stating their approval of the closure of the block for the party on the designated day;
An explanation of how the block is to be barricaded, causing traffic to use reasonable alternate routes.

There shall be paid, at the time of filing the application for a block party permit, a fee as provided for in the fee schedule found in appendix A of this code.

The city manager shall issue a permit as provided for hereunder when, from a consideration of the application and from such other information as may otherwise be obtained, he finds that:
The conduct of such block party will not require the diversion of so great a number of ambulances as to prevent normal ambulance service to portions of the city other than that to be occupied by the proposed block party and areas contiguous thereto;
The concentration of persons expected to attend the block party will not unduly interfere with proper fire and police protection of, or ambulance service to, areas contiguous to such area;
The conduct of the block party is not reasonably likely to cause injury to persons or property, to provoke disorderly conduct or to create a disturbance;
The block will be sufficiently barricaded at either end of the block such that traffic is not likely to enter the street during the block party.

The city manager shall act upon the application for a block party permit within three (3) days after the filing thereof. If the city manager disapproves the application, he shall mail to the applicant, within three (3) days after the date upon which application was filed, a notice of his action, stating the reasons for his denial of the permit.

The city manager shall have the authority to revoke a block party permit issued hereunder upon application of the standards for issuance as herein set forth.

Any person aggrieved shall have the right to appeal the denial of a block party permit to the city council. The appeal shall be taken within ten (10) days after notice. The city council shall act upon the appeal at its next regularly scheduled meeting.
