There is hereby created and established a municipal court technology fund as provided in Vernon’s Acc. C.C.P. article 102.0172.

The fund may be maintained in an interest bearing account and may be maintained in the general revenue account.

§ 7.302 Establishment of Amount of the Fee and Assessment and Collection.

(a)

The maximum fee permitted by statute shall be imposed as a court cost to be paid by every person convicted of a misdemeanor in the municipal court pursuant to Vernon’s Acc. C.C.P. article 102.0172. The technology fee shall be assessed and collected for each separate case, matter, or charge upon which any defendant is convicted in the municipal court as a cost of court.

(b)

A defendant is considered convicted if:

(1)

A sentence is imposed on the person;

(2)

The person is placed on community supervision, including deferred adjudication community supervision; or

(3)

The court defers final disposition of the person’s case.

(c)

The clerk of the court shall collect the fee and pay the fee to the municipal treasurer of the city, who shall deposit the fee into the municipal court technology fund.

§ 7.303 Designated Use of the Fund and Administration.

(a)

The fund shall be used only to finance the purchase of technological enhancements for the municipal court of the city, including:

Computer systems;

Computer networks;

Computer hardware;

Computer software;
