As used in this article, the following words and phrases shall have the following meanings:
Minor.
Means a person under the age of 18 years of age.
Possession.
Means to have on or about the person.
Tobacco Product.
Means:
(1) 
a cigarette;
(2) 
a cigar;
(3) 
smoking tobacco, including granulated, plug-cut, ready rubbed, and any form of tobacco suitable for smoking in a pipe or as a cigarette;
(4) 
chewing tobacco, including Cavendish, Twist, plug, scrap, and any kind of tobacco suitable for chewing;
(5) 
snuff or other preparations of pulverized tobacco;
(6) 
any other article or product that is made of tobacco.
A minor commits an offense if the minor possesses a tobacco product; provided, however, that it is not a violation of this article for a minor to possess a tobacco product if such possession is in violation of Section 48.01, Tex. Pen. Code, as amended.

It is a defense to a prosecution for violation of Section 8.832 of this article that a minor possessed a tobacco product:
(1) 
while in the course and scope of the minor's employment by a person or entity holding a permit issued by the state authorizing the person to engage in the business of being a distributor, wholesaler, bonded agent or retailer of tobacco products; or
(2) 
in the presence of an adult parent, guardian, or spouse, or in the presence of another adult to whom the minor has been committed by a court.

It is an offense for a minor to purchase a tobacco product. It is a defense to prosecution under this section that the minor purchased a tobacco product in the presence of an adult parent, guardian, or spouse, or other adult to whom the minor has been committed by a court.

It is an offense for a minor, in order to acquire a tobacco product, to state to any person engaged in the business of selling tobacco products that such minor is not a minor, or to present to any such person a document or writing that purports to establish that such minor is not a minor.

It shall be unlawful for any person to violate any provision of this article, and any person violating or failing to comply with any provision hereof shall be fined, upon conviction, in accordance with the general penalty provision in Section 1.109 of this code, and a separate offense shall be deemed committed each day during or on which a violation occurs or continues.
