The use of a refuse, trash, or garbage container by a person without the permission of the owner of said container shall be prohibited.

Violation of the provision of Section 13.1201 above shall constitute a misdemeanor and shall be punishable by a fine in accordance with the general penalty provision in Section 1.109 of this code.
