(a) 
Any person pursuing or engaged in handling, selling, offering for sale or giving away any type of fireworks, including firecrackers, Roman candles or explosive type fireworks of any kind whatever, or who may distribute same, shall be deemed guilty of violating the provisions of this article and shall be guilty of a misdemeanor and, upon conviction, shall be subject to penalty as provided in section 1.01.009 of this code, and each day of so offending shall be constituted a separate offense.
(b) 
Any person using, handling, exploding, displaying or in any other way using fireworks, firecrackers or Roman candles, including any other type of fireworks, bombs or any other type of materials used to create explosions or noise or ignition, or who shall pursue or engage in such, shall be guilty of a misdemeanor and, upon conviction, shall be subject to penalty as provided in section 1.01.009 of this code.

(a) 
Sale prohibited.
It shall be unlawful for any person to handle, keep, sell, offer for sale or give away any type of fireworks, including firecrackers, Roman candles or any such fireworks which create noise, fire, or display of fire or whether used for making undue noise such as might be described as bombs, caps or any other such like devices.
(b) 
Use prohibited.
It shall be unlawful for any [person] to handle, explode, use, display, ignite, set off or in any manner use fireworks within the city limits, including the use of any firecrackers, Roman candles or any other type of fireworks or devices as they may be so termed and any instruments which create noise or explosions.

No clause herein shall be construed to exclude, upon proper permit, the right of the city council to grant a special permit to a responsible person upon any special occasion, to allow a designated fireworks display when such may be deemed by the city council to be necessary for the entertainment of the general public. In this case, no such public display shall be made nor any fireworks used until such person presents to the city council, at a regular or special meeting thereof, an application, designating and outlining clearly the purpose, the place of use, the time and all other information relative thereto. Then, if, in the opinion of the city council, such display or entertainment is for the general entertainment of the citizens, the city council may grant to such person a special permit for such special occasion and require from such person all the necessary protection or indemnity, in the opinion of the city council, which may be required to protect property and persons, etc. In any event hereof, all requirements, including the permit and all other requirements prescribed by the city council, must be first obtained before the use, display or exploding of any such fireworks within the limits of the city.
