As used in this chapter, the following terms shall have the
meanings indicated:
Inhaling, exhaling, or burning any lighted cigarette, cigar,
pipe, or other such device which contains tobacco or other smoke-producing
products.
No person shall smoke at or in any West Manheim Township-owned
or -leased real property, building, vehicle or facility, including
parks and open space areas.
A.
The West Manheim Township Police Department and Code Enforcement
Official shall have the power to enforce the provisions of this chapter,
and may bring any action at law or in equity to secure compliance
with the provisions of this chapter and/or collect any fine imposed.
B.
Any person who violates this chapter shall, upon conviction in a
summary proceeding brought before a Magisterial District Judge under
the Pennsylvania Rules of Criminal Procedure, be guilty of a summary
offense and shall be punishable by a fine of not more than $1,000,
plus costs of prosecution. In default of payment thereof, the defendant
may be sentenced to imprisonment for a term not exceeding 90 days.
Each day or portion thereof that such violation continues or is permitted
to continue shall constitute a separate offense, and each section
of this chapter that is violated shall also constitute a separate
offense.
