There exists the office of emergency management director of the town, which shall be held by the mayor in accordance with state law. An emergency management coordinator may be appointed by and serve at the pleasure of the director, who shall be responsible for a program of emergency management within the town and for carrying out the duties and responsibilities set forth in this division. The operational emergency management organization of the town shall consist of the officers and employees of the town so designated by the director.

The duties and responsibilities of the emergency management director shall include a survey of actual [and] potential hazards which threaten life or property within the town; supervision of the development and approval of any emergency management plans for the town, including adoption of all mutual aid arrangements deemed necessary for implementation of any plan; authority to declare a local state of disaster; issuance of necessary proclamations, regulations and directives necessary to carry out the purpose of this division; maintenance of liaison with other municipal, county, district, state, regional or federal emergency management organizations; execution of mutual aid agreements in cooperation with the representatives of the state and of other local political subdivisions of the state; and any other requirements as specified in the Texas Disaster Act of 1975 (V.T.C.A., Government Code, chapter 418).

The mayor is hereby authorized to join with the county judge and the mayors of the other cities in the county in the formation of an emergency management council for the county and shall have the authority to cooperate in the preparation of a joint emergency management plan and in the appointment of a joint emergency management coordinator, as well as all powers necessary to participate in a county-wide program of emergency management insofar as said program may affect the town.

This division is in exercise by the town of its governmental functions for the protection of the public peace, health and safety, and neither the town, the agents and representatives of the town, nor any individual, partnership, corporation or other entity, nor any agents thereof, in good faith complying with any order, rule or regulation promulgated pursuant to provisions of this division shall be liable for any damage sustained to persons or property as a result of such activity.

This division shall not be construed so as to conflict with any state or federal statute or with any military order, rule or regulation.
