The purpose of this division is to officially name the publicly
owned facility located at 505 Lakeshore Drive as Overton Club House,
to amend the rental rate and deposit for the use of said building,
and to establish the rules and regulations for the use of the facility
to protect public health, safety, welfare and the publicly owned facility.

The facility owned by the city and located at 505 Lakeshore
Drive, Overton, Texas shall hereby be officially named as “Overton
Club House.”

(a) The rental rate for the Overton Club House is a $75.00 per day rental
fee for any City of Overton utility customer with a current valid
utility account plus a security deposit, and a rental rate of $200.00
per day rental fee for any person not having a current valid utility
account with the City of Overton plus a security deposit.
(b) The security deposit for the Overton Club House is $100.00 for a
non-alcohol event.

Drug paraphernalia.
Any equipment, product, or material that is used or intended
to be used for the purpose of planting, cultivating, manufacturing,
producing, processing, testing, packing, storing or concealing a controlled
substance.
Illegal drugs (narcotics).
Drugs which have legal limitations on their ownership or
use. They are illegal in certain situations (meaning a person is not
allowed to have them). A drug is any chemical that affects the human
body or mind when it is swallowed, breathed in, or consumed in another
way. A psychoactive drug is a drug that affects the brain.
Lease.
The agreement to pay a set fee for the purpose of utilization
of the Overton Club House.
Lessee.
A person or organization that seeks to lease/rent the Overton
Club House.
Security deposit.
A set fee for the purpose of securing a said rental date
and insuring that the said Overton Club House building, equipment
and grounds shall be left in the same clean condition as when it was
rented.
Sponsor.
A responsible adult given the authority by the lessee to
supervise and be a representative of the lessee in insuring the public
facility is protected from damage to the grounds, equipment and building.

(a) The lease agreement application form must be submitted to city hall
personnel in person by the individual leasing the building.
(b) The lease is not considered in effect until the security deposit
has been paid in full.
(c) Reservations will be taken in order of the reservation requested.
Security deposits are allowed to “roll over” (be held
on file for the next rental); however, the lessee must complete a
new lease agreement application for each reservation each time (the
rental date desired is not guaranteed).
(d) The lessee must be a responsible adult, at least twenty-one (21)
years of age, and must submit payment in full and provide a signed
complete lease agreement application before the key will be issued.
(e) The city does not allow any alcoholic beverages at the Overton Club
House facility. Therefore, the rental with the option for service
of any alcoholic beverage, including but not limited to beer or wine,
is strictly prohibited. Violators of this provision shall immediately
be subject to forfeiture of their security deposit if witnessed by
any member of the city staff or evidence is found or before, during
or after said rental by a member of city staff.
(f) This facility is located within the city’s designated “Drug
Free Zone”; therefore, any evidence of drugs or drug paraphernalia
shall be grounds for the lessee forfeiture of their security deposit
if witnessed by any member of the city staff or evidence is found
or before, during or after said rental by a member of city staff.
(g) Rental begins as of 8:00 a.m. on the date of rental (unless previous
arrangements have been made with the city) and ends as of 11:59 p.m.
the date of rental which shall be verified by the city patrol officer
on duty. If rental is to last past 12:00 a.m. of the following day
an additional day’s rental must be paid in advance or the lessee
shall forfeit the entire deposit made for the rental of the building.
(h) The building key must be returned to city hall with the Overton Club
House clean-up list form signed as soon as possible following use
of the building. (The key may be placed in the drop box located to
the right of city hall front door.)
(i) The lessee shall be held accountable for any damage done to the building,
equipment and/or grounds for reasonable replacement/repair costs.
(j) The lessee agrees to leave the building, equipment and grounds in
clean and orderly condition.
(k) The lessee shall be held responsible for the decent and orderly conduct
of all guests or persons allowed access to the premises during the
lease. Failure to do so as agreed will result in forfeiture of the
security deposit made by the lessee.
(l) Sponsors of parties for minors must be present at all times. It is
required that there is at least one sponsor for each ten (10) minors.
(m) The city has the right to terminate any future lease to the lessee
if evidence of damage to the building is found or the lessee fails
to leave the facility and the premises (including the exterior and
parking lot) clean in accordance with the Overton Club House clean-up
list.
(n) The city has the right to terminate the future lease of the facility
for the need or use of any city-sponsored event.
(o) The lessee and sponsors agree to see that the following rules are
observed, and that all property of the city is protected against loss
or breakage and left in a clean and orderly manner. Restrooms, tables,
and chairs are to be cleaned and put away after each event.
(1) Any decorations used must be attached only using tape and must be
removed as per the posted Overton Club House clean-up list. Nails,
staples or anything that leaves holes in the walls or woodwork is
strictly prohibited; the security deposit shall be forfeited if nail
holes, staples or tape remnants are found.
(2) Moving of any appliances or fixtures is strictly prohibited and will
result in forfeiture of the security deposit and loss of future use
of the building.
(3) Smoking is strictly prohibited inside of the Overton Club House.
(p) The city shall furnish only that which is at hand. Any service other
than keeping the building clean will have to be furnished by the lessee.
(q) The security deposit fee shall be forfeited if the reservation is
not cancelled at least seven (7) calendar days prior to the event
date. Cancellations will be accepted by phoning city hall personnel.
Unless contact is made, forfeiture of fees shall be assessed.
(r) The Overton Club House is furnished for your pleasure and benefit,
and charges are made for the actual maintenance and upkeep of the
building. Please be courteous and preserve it for the use of others
in the future.

A lessee commits an offense if he allows, provides or serves
any alcoholic beverage without having properly notified the city that
alcoholic beverages would be present at the Overton Club House during
the said rental dates and/or times on the lease agreement.

All Overton Club House events are subject to drive-by and on-site inspections at any time during event by the city police department or an authorized representative of the city. A police officer, upon finding a violation of section
10.03.066, shall ascertain the name and address of the lessee and may issue a citation to the lessee.

Any person who violates section
10.03.066 of this division shall lose said security deposit and be punishable by a fine in accordance with the general penalty provided in section
1.01.009 of this code.
