The purpose of this article is to regulate the flow and to control disposal of solid waste generated within the city and to provide management control over solid waste to encourage recycling of materials from solid waste.

Disposal.
The discharge, deposit, injection, dumping, spilling, leaking, or placing of any hazardous or solid waste at the waste facility.
Hazardous Waste.
A waste substance or material in any physical state designated as hazardous by the Texas Commission on Environmental Quality.
Special Waste.
Any nonhazardous [waste] which requires special handling, transportation and disposal. Examples include, but are not limited to:
(1) 
Oil, coal, wood and multifuel boiler and incinerator ash.
(2) 
Industrial process waste.
(3) 
Wastewater, treatment plant sludge, paper mill sludge and other sludge waste.
(4) 
Debris and residuals from nonhazardous chemical spills and cleanup.
(5) 
Contaminated soils and dredge spoils.
(6) 
Asbestos and asbestos containing water.
(7) 
Sand blast grit and nonliquid paint waste.
(8) 
Medical and biological waste.
(9) 
Asphalt shingles.
(10) 
Tires.
(11) 
Motor oil.
(12) 
Motor vehicle batteries.
(13) 
High and low pH waste.
(14) 
Propane gas tanks.
(15) 
Computer terminals or monitors.
(16) 
Any other waste designated by the Texas Commission on Environmental Quality as impermissible for disposal in a type I landfill.
Solid Waste.
Useless, unwanted, or discarded solid material with insufficient liquid content to be free flowing, including, by way of example and not by limitation, rubbish, garbage, scrap material, junk refuse, and landscape refuse but shall not include septic tank sludge or agricultural waste.

Disposal of solid waste will be allowed only during the hours posted for the use of the facility. Those hours will be set by the city council and will be posted on a sign located by the entrance to the facility.

All solid waste will be sorted and disposed of in the manner and areas so designated by the attendant on duty at the solid waste facility. Rules outlining the manner of disposal will be adopted and updated as necessary by the city administrator to ensure compliance with the regulations of the Texas Commission on Environmental Quality.

All commercial haulers shall obtain a permit from the city secretary prior to delivery of any solid waste at the facility.

All loads brought to the solid waste facility shall be properly secured with a tarp tied to the vehicle adequately to prevent the spillage of waste from the load.

Residents of the city may dispose of two (2) 4 x 8 (standard size) pickup loads or carloads per month at no charge, or alternatively, residents of the city may dispose of one sixteen-foot trailer load per month at no charge. Proof of residence, in the form of a water bill in the name of the party delivering the load, dated within 30 days of the date of disposal, shall be required.
Commercial fees shall be set by permit only. Where permissible free loads have been exceeded or are inapplicable, the fee schedule in effect and on file in the office of the city secretary shall apply.

The attendant on duty shall limit, when necessary, the volume of debris to be disposed of by any one patron or in any calendar day, depending on the attendant’s determination that acceptance of such solid waste will have a negative impact on the operation of the solid waste facility. The attendant shall notify the patron as soon as is feasible, and public notice, if necessary, shall be posted on the entrance sign where applicable.

Any person, firm or corporation who violates any of the provisions of this article shall, upon conviction, be guilty of a misdemeanor and fined not less than $1.00 nor more than $2,000.00 for such offense. Each day a violation occurs or continues shall be a separate offense.
